Supreme Court (Chapter II Amendment No. 2)

Rules 2000

The Judges of the Supreme Court make the following Rules:

1. Object

The object of these Rules is to amend the

Principal Rules to—

(a)

clarify the procedure for applications for leave to appeal under section 38 of the Commercial Arbitration Act 1984; and

(b)

amend the requirements relating to admission to legal practice.

2. Authorising provisions

These Rules are made under section 25 of the powers.

3. Commencement

These Rules come into operation on

1 October 2000.

4. Principal Rules

In these Rules, Chapter II of the Rules of the Supreme Court1 is called the Principal Rules.

5. Appeal under section 38

In Rule 9.06 of the Principal Rules, at the end of
the Rule insert—

"(2) An application for leave to appeal under

section 38 of the Act shall be made to a

Judge.".

6. New Rule 14.05

For Rule 14.05 of the Principal Rules substitute—

"14.05 Oath or affirmation of office—Form 2–14

(1) A person applying to be admitted to legal practice in Victoria shall take an oath, or make an affirmation, of office.

(2) The oath or affirmation may be in

Form 2–14.".

7. Revocation of redundant provisions

Rules 14.06, 14.07, 14.08 and 14.09 of the

Principal Rules are revoked.

8. New Form 2–14

For Forms 2–14A and 2–14B of the Principal

Rules substitute—

"FORM 2–14

Rule 14.05(2)

OATH OF OFFICE

I swear by almighty God that I will well and honestly conduct myself in the practice of my profession as a barrister and solicitor and as an officer of this honourable Court to the best of my knowledge and ability.

AFFIRMATION OF OFFICE

I solemnly sincerely and truly declare and affirm that I will well and honestly conduct myself in the practice of my profession as a barrister and solicitor

and as an officer of this honourable Court to the best of my knowledge and

ability.".
