Supreme Court (Chapter I Miscellaneous Amendments) Rules 2020
The Judges of the Supreme Court make the following Rules:
1Object
The object of these Rules is to amend Chapter I of the Rules of the Supreme Court—
(a)to update Order 77 to refer to the Guardianship and Administration Act 2019 which has replaced the Guardianship and Administration Act 1986; and
(b)to further provide for powers of judicial registrars in relation to Funds in Court.
2Authorising provisions
These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.
3Commencement
These Rules come into operation on 6 July 2020.
4Principal Rules
In these Rules, the Supreme Court (General Civil Procedure) Rules 2015[1] are called the Principal Rules.
5Authority
For Rule 77.01(2)(a)(v) of the Principal Rules substitute—
"(v)section 179 of the Guardianship and Administration Act 2019;".
6Application of money
In Rule 79.02(1)(c) of the Principal Rules—
(a)in paragraph (c) omit "or";
(b)in paragraph (d) for "1996." substitute "1996; or";
(c)after paragraph (d) insert—
"(e)section 69 of the Trustee Act 1958.".
7Authority
At the end of Rule 79.12 of the Principal Rules insert—
"(2)The judicial registrar may order payment into Court of funds for any person, estate or trust if the Senior Master holds funds in Court for that person, estate or trust.".
