Supreme Court (Chapter I Judicial Review Amendment) Rules 2024

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to amend Chapter I of the Rules of the Supreme Court in relation to stay of decisions in judicial review proceedings.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 26 August 2024.

4New Rule 56.06

After Rule 56.05 of the Supreme Court (General Civil Procedure) Rules 2015[1] insert—

"56.06   Stay

(1)The Court, at any time, may stay the decision or action the subject of the proceeding in order to ensure the effective exercise of the Court's jurisdiction.

(2)A stay order may be granted on such terms, and subject to such conditions and limitations, as the Court thinks fit.".
