Supreme Court (Chapter I Amendment No. 8) Rules 2007

The Judges of the Supreme Court make the following Rules:

1Object

The object of these Rules is to amend Chapter I of the Rules of the Supreme Court to make further provision for indorsement of originating process for service out of Australia and to make minor statute law revision amendments.

2Authorising provisions

These Rules are made under section 25 of the Supreme Court Act 1986 and all other enabling powers.

3Commencement

These Rules come into operation on 1 May 2007.

4Indorsement on originating process

After Rule 7.02(1) of the Supreme Court (General Civil Procedure) Rules 2005[1] insert—

"(1.1)The indorsement under paragraph (1) shall be distinct from the indorsement of claim on the originating process, but any fact in support of service out of Australia which is a fact alleged by the indorsement of claim may be incorporated by specific reference in the indorsement under paragraph (1).".

5Statute law revision

In the Supreme Court (General Civil Procedure) Rules 2005—

(a)in Rule 9.07(3), for "he" substitute
"the person";

(b)in Rule 12.05(1), for "Rule 12.03A" substitute "Rule 12.03".
