Supreme Court (Chapter I Amendment No. 20)

Rules 2002

The Judges of the Supreme Court make the following Rules:

1. Object

The object of these Rules is to make miscellaneous amendments to the Principal Rules.

2. Authorising provision

These Rules are made under section 25 of the powers.

3. Commencement

These Rules come into operation on 1 July 2002.

4. Principal Rules

In these Rules, the Supreme Court (General Civil
Procedure) Rules 19961 are called the Principal

Rules.

5. New definition of bank

(1) In Rule 1.13(1) of the Principal Rules, insert the

following definition—

' "bank" means an authorised deposit-taking

institution within the meaning of the

Banking Act 1959 of the Commonwealth;'.

(2) In Rule 39.01(2) of the Principal Rules, the

definition of "bank" is revoked.

(3) At the foot of Rule 39.05 and Rule 71.03(1)

respectively, insert—

'Note: "bank" is defined in Rule 1.13(1).'.

6. Address for service

In Rule 20.05(2)(a) of the Principal Rules, for "Rule 20.03(3)(a)" substitute "paragraph (3) or (4) of Rule 20.03".

7. Application of Order 33

In Rule 33.01 of the Principal Rules after "for" insert ", or otherwise claims in respect of,".

8. Amendments to Appendix A

In Appendix A to the Principal Rules—

(a)	in item 7, after "For" insert "witness statements, summaries of evidence or like documents,";
(b)	in item 25, after "(which exceed three folios)," insert "applications by summons, notice or otherwise,".
