Supreme Court (Chapter I Amendment No. 2)
Rules 1996
The Judges of the Supreme Court make the following Rules:
1. Object
The object of these Rules is to make general provision for case management.
2. Authorising provisions
These Rules are made under section 25 of the powers.
3. Principal Rules
In these Rules, the General Rules of Procedure in
Civil Proceedings 19961 are called the Principal
Rules.4. Amendment of Rule 3.02—Extension and abridgement
In Rule 3.02(3) of the Principal Rules for "Any time" substitute "Unless the Court constituted by a Judge otherwise orders, any time".
5. New Rule 29.16 inserted
After Rule 29.15 of the Principal Rules insert—
"29.16 Discovery after directions
If the Court gives directions about discovery or inspection of documents, no party may,

without further order, serve notice for discovery on any other party except in accordance with those directions.".
6. New Rule 30.12 inserted
After Rule 30.11 of the Principal Rules insert—
"30.12 Interrogatories after directions
If the Court gives directions about interrogatories or answers to interrogatories, no party may, without further order, serve interrogatories on any other party except in accordance with those directions.".
7. Substitution of the heading to Order 34
For the heading to Order 34 of the Principal Rules substitute—
"ORDER 34
DIRECTIONS
PART 1—GENERAL".
8. New Part 2 of Order 34 inserted
After Rule 34.04 of the Principal Rules insert—
"PART 2—CASE MANAGEMENT
34.05 Case management
(1) Any proceeding commenced by writ filed
before 1 November 1996 shall stand
dismissed on 1 July 1997 unless, before 1July 1997—
(a)
it has been admitted to one of the following lists—

Commercial List
Corporations List
Intellectual Property List
Long Cases List
Major Torts List
Valuation and Compensation List or,
after 3 February 1997, the Valuation,
Compensation and Planning List; or
(b)
it has been set down for trial pursuant to Order 48 or an order has been made that it be fixed for hearing; or
(c)
the Court constituted by a Judge has ordered that this Rule not apply to the proceeding.
(2) The Court constituted by a Judge may
reinstate any proceeding that stands
dismissed by the operation of paragraph
(1).".
9. Amendment of Rule 59.06—Consent judgment or order by filing
In Rule 59.06(1) of the Principal Rules for "If"
substitute "Unless the Court constituted by aJudge otherwise orders, if ".
