1. N o J u d g e of the Supreme Cour t shall sit on t he hea r ing of an appeal from or on a motion to set aside any j u d g m e n t order

decree

ru l ing or decision m a d e by h im.

2. The Cour t on the hear ing of any such appeal or mot ion shall

consist of th ree J u d g e s .

3. Provided always t h a t th is Ac t shall not apply to any j u d g m e n t order decree or ru l ing p ronounced or made pro forma by consent of par t ies nor to any mot ion for a rule nisi only nor to t he hear ing of an appeal or motion before two J u d g e s only Avhere t he

par t ies consent there to .
