Supreme Court Amendment Rules (No. 3) 2009

Made by the Judges of the Supreme Court.

1.           Citation

These rules are the Supreme Court Amendment Rules
(No. 3) 2009.

2.            Commencement

These rules come into operation when the National Gas Access
(WA) Act 2009 Part 2 comes into operation.

3.             Rules amended

These rules amend the Rules of the Supreme Court 1971.

4. Order 81D amended
(1) InOrderSiD rule 1A:

(a) delete "This Order" and insert:

(1) This Order

(b) delete "to a determination" and insert:

regulations made under that Act; and

to an appeal from a determination

(c) delete "1998." and insert:

1998, including an appeal continued or commenced
after the repeal of that clause as a result of the

operation of the national gas transitional provisions.

(2) At the end of Order 81 D rule 1A insert:

(2) Insubrule(1)-

national gas transitional provisions means the

provisions of—

(a) the National Gas Access (WA) Act 2009 and the

(b) the National Gas Access (Western Australia)

Law and the National Gas Rules, as defined in that Law,

savings nature relating to the transition from the
application of provisions of the Gas Pipelines Access
Law, as defined in the National Gas Access (WA) that deal with matters of a transitional, application or the National Gas Access (Western Australia) Law.
