Supreme Court Amendment Rules 2008

We, the Honourable Peter George Underwood, Officer of the Order of Australia, Chief Justice, and the Honourable Ewan Charles Crawford, the Honourable Pierre William Slicer, the Honourable Peter Ethrington Evans, the Honourable Alan Michael Blow, OAM, and the Honourable Shan Eve Tennent, Puisne Judges of the Supreme Court of Tasmania, on the recommendation of the Rule Committee, make the following Rules of Court under the Supreme Court Civil Procedure Act 1932 .

1Short titleThese Rules of Court may be cited as the Supreme Court Amendment Rules 2008 . 2CommencementThese Rules of Court take effect on the day on which the Supreme Court Amendment Act 2007 commences. 3Principal RulesIn these Rules of Court, the Supreme Court Rules 2000 are referred to as the Principal Rules. 4Rule 5 amended (Interpretation) Rule 5 of the Principal Rules is amended by omitting "Master" from paragraph (b) of the definition of officer and substituting "Associate Judge". 5Rule 361 amended (Directions) Rule 361(2) of the Principal Rules is amended by omitting "the Master or". 6Rule 511 amended (Affidavits sworn within Australia) Rule 511(1)(b) of the Principal Rules is amended by omitting "Master" and substituting "Associate Judge". 7Rule 561 amended (Trial by other adjudicator) Rule 561(1)(a) of the Principal Rules is amended by omitting "Master" and substituting "Associate Judge". 8Part 27, Division 1A: Heading amended Division 1A of Part 27 of the Principal Rules is amended by omitting "Appeal from Master" from the heading to that Division and substituting "Appeal from Associate Judge". 9Rule 680A amended (Appeal from Associate Judge) Rule 680A of the Principal Rules is amended as follows: (a) by omitting from subrule (2) "Master" and substituting "Associate Judge"; (b) by omitting from subrule (9)(g) "Master’s" and substituting “Associate Judge’s”; (c) by omitting from subrule (16) "Master" and substituting "Associate Judge". 10Rule 783D amended (Hearing date) Rule 783D(a) of the Principal Rules is amended by omitting "Master" and substituting "Associate Judge". 11Rule 783G amended (Documents to be produced at hearing) Rule 783G of the Principal Rules is amended by omitting "Master" and substituting "Associate Judge". 12Rule 816 amended (Settlement of judgments and orders by judge) Rule 816 of the Principal Rules is amended as follows: (a) by omitting from subrule (1) "Master" and substituting "Associate Judge"; (b) by omitting from subrule (2) "Master" and substituting "Associate Judge". 13Rule 961 amended (Account or inquiry) Rule 961 of the Principal Rules is amended as follows: (a) by omitting from subrule (1) "Master" and substituting "Associate Judge"; (b) by omitting from subrule (2) "Master" and substituting "Associate Judge"; (c) by omitting from subrule (4) "Master" and substituting "Associate Judge"; (d) by omitting from subrule (5) "Master" and substituting "Associate Judge"; (e) by omitting from subrule (7) "Master" and substituting "Associate Judge"; (f) by omitting from subrule (8) "Master" and substituting "Associate Judge". 14Part 37: Heading amended Part 37 of the Principal Rules is amended by omitting "THE MASTER" from the heading to that Part and substituting "THE ASSOCIATE JUDGE". 15Rule 962 amended (Jurisdiction of Associate Judge) Rule 962 of the Principal Rules is amended as follows: (a) by omitting from subrule (1) "Master" and substituting "Associate Judge"; (b) by omitting from subrule (2) "Master" and substituting "Associate Judge". 16Rule 963 amended (Reference to judge) Rule 963 of the Principal Rules is amended by omitting "Master" and substituting "Associate Judge". 17Rule 964 amended (Recording of proceedings) Rule 964 of the Principal Rules is amended by omitting "Master" and substituting "Associate Judge". 18Rule 974 amended (Manner of taking examination) Rule 974(2)(c) of the Principal Rules is amended by omitting "Master" twice occurring and substituting "Associate Judge".
