BIGBY, Clerk of the Council SUPREME COURT (AMENDMENT) RULES 1991 (NO. 4) Short title 1. These rules may be cited as the Supreme Court (Amendment) Rules 1991(No.4).
2 Supreme Court (Amendment) Rules 1991 (No. 4) No. 46, 1991 Commencement 2. These rules commence on 1 September 1991. Amended rules 3. The Rules of the Supreme Court are amended as set out in these rules. Replacement of Third Schedule. 4. The Third Schedule— omit, insert— ‘SCHEDULE 3 SCALE OF FEES This Schedule does not apply to or affect the existing fees and percentages directed to be taken or paid by any Statute and in respect of which no fee or percentage is provided in this Schedule. Part 1 applies to all continuing actions or matters commenced before 1 October 1982. Except where otherwise indicated Part 2 applies to all actions or matters commenced on or after 1 October 1982. No fees are to be required from the Sheriff or Marshal. NOTE—The fees prescribed to be paid on application for admission as barristers or solicitors, include the filing of all certificates from the respective Boards, and of all affidavits and other documents necessary to be filed in connection with the application, as well as administering the oaths of allegiance and of office, and sealing the certificate of admission.

11 Supreme Court (Amendment) Rules 1991 (No. 4) No. 46, 1991 OTHER REFERENCES, INQUIRIES AND ACCOUNTS 17. *On taking an account of a receiver, guardian, consignee, bailee, manager, provisional official, or voluntary liquidator, or sequestrator, or of an executor, administrator, trustee, agent, solicitor, mortgagee, co-tenant, co-partner, execution creditor, or other person liable to account, for every $300 or part of $300 of the amount or value found to have been received without deducting any payment in the cause or matter, on the account taken . . . . . . . . . . . . . . . . In the case of any such receiver, guardian, consignee, bailee, manager, liquidator, sequestrator, or execution creditor, the fees are, upon payment, to be allowed in the account, unless the Court or Judge otherwise directs, and in the case of taking the accounts of any other accounting parties, the fees are to be paid by the party having the conduct of the order under which the account is taken, as part of that party’s costs of the cause or matter (unless the Court or a Judge otherwise directs), and in such a case are to be taken upon the certificate of the result of any such account, but the fees shall be due and payable, although no certificate is required, on the account taken, or on such part of the account, as may be taken, and the solicitor or party shall in such case cause the proper fees to be paid (the amount of those fees to be fixed by the officer). The officer taking the account may require a deposit on account of fees (not exceeding the fees on the full amount appearing by the account to have been received) before taking the account, and the officer or the officer’s clerk is to make a memorandum of the deposit in the account. The fees are not payable twice on the same money in the same cause or matter, but only upon sums of money for the first time received or collected by the party accounting. $ 3.00 51.50

18 Supreme Court (Amendment) Rules 1991 (No. 4) No. 46, 1991 If the Marshal or any of the Marshal’s officers is required to go to a greater distance than eight kilometres from that person’s office to perform any of the above duties that person is entitled to reasonable expenses for travelling, board, and maintenance, in addition to the above fees. 63.
