The Supreme Court Rule Committee made the following rules of court under the

Supreme Court Act 1970 on 18 December 2000.

Explanatory note

The object of these Rules is to amend the Supreme Court Rules 1970 to assign proceedings in which a claim is made for relief under the Competition Policy Reform (New South Wales) Act 1995 or the Price Exploitation Code (New South Wales) Act 1999 to the Common Law Division or the Equity Division, as is appropriate to the nature of the proceedings.
These Rules are made under the Supreme Court Act 1970, including section 124

(the general rule-making power).

Supreme Court Rules (Amendment No 345) 2000

1     Name of Rules

These Rules are the Supreme Court Rules (Amendment No 345) 2000.

2 Amendment of Supreme Court Rules 1970

The Supreme Court Rules 1970 are amended by omitting rule 7 of
Part 12 and by inserting instead the following rule:

7          Business assigned to one of several Divisions

Proceedings in the Court in which a claim is made for relief

under:

(a)

the Fair Trading Act 1987 (except proceedings specified in the Third Schedule to the Act or assigned by Part 75), or

(b)

Division 1 or 1A of Part V of the Trade Practices Act 1974, or

(c)

the Competition Policy Reform (New South Wales) Act 1995, or

(d)

the Price Exploitation Code (New South Wales) Act 1999,

are to be assigned to the Common Law Division or the Equity
Division, as is appropriate to the nature of the proceedings.
