SUPREME COURT ACT 1970 - RULE

SUPREME COURT RULES (AMENDMENT No. 245) 1990.
1. These rules are made by the Rule Committee on 16 July 1990.
2. The Supreme Court Rules 1970 are amended as follows:
(a) Part 1 rule 3 to the De Facto Relationships Act 1984 insert:
in the column in the column in the column 'Statute'' - "Division" - "Rules" - "Drug Trafficking 25A 84A - 84C". (Civil Proceedings) Act 1990
(b) Part 52
After rule 47 insert:Drug Trafficking (Civil Proceedings) Act 1990
47A. (1) An application for an order under section 17 of the Drug Trafficking (Civil Proceedings) Act 1990 may be made by motion in the proceedings for the restraining order.
(2) Upon an order being made under section 17 of that Act, an application to proceed with the taxation shall be made to a taxing officer by motion in the proceedings.

Assignment of business
84A Proceedings in the Court under the Drug Trafficking
(Civil Proceedings) Act 1990 (the “subject Act") are
assigned to the Criminal Division.
Examination order: prescribed officer (s. 12)
84B. An officer prescribed for the purposes of section 12 (1) (b)
of the subject Act is a master or registrar.
Information for production order
84C. An information setting out the grounds mentioned in section 33 (1) may be laid before the Court by filing an affidavit setting out those grounds.
3. Paragraph 2 of this Amendment takes effect on and from the date of commencement of the Drug Trafficking (Civil Proceedings) Act 1990.
EXPLANATORY NOTE
(This note does not form part of the rules)
The purposes of the above Amendment are to make provisions consequential on the passing of the Drug Trafficking (Civil Proceedings) Act 1990.
