Council, has made the following Regulation under the Supreme Court Act

The object of this Regulation is to amend the Schedule of fees for matters filed in the Supreme Court as a consequence of the establishment of a Commercial List in the Equity Division of the Court.
This Regulation is made under section 130 of the Supreme Court Act 1970.

1 Name of Regulation

This Regulation is the Supreme Court (Fees and Percentages)

Amendment (Commercial Matters) Regulation 1998.

2 Commencement

This Regulation commences on 1 September 1998.

3 Amendment of Supreme Court (Fees and Percentages) Regulation 1993

The Supreme Court (Fees and Percentages) Regulation 1993 is amended as set out in Schedule 1.

Schedule 1 Amendments

(Clause 3)

[1]       Clause 9 Repeal and savings provisions

Insert after clause 9 (2):

(3) No fee is payable in respect of the entry of proceedings
in Commercial List if the proceedings were in the
Commercial Division immediately before 1 September
1998 and the entry was pursuant to an order of the Court.

[2]        Schedule 1 Court Fees

Omit “except in the Commercial and Probate Divisions and the
Court of Appeal" from Item 1 (a).
Insert instead "except in the Equity Division for entry in the
Commercial List. or in the Probate Division or Court of Appeal".

[3]       Schedule 1, Item 1 (b)

Omit "Commercial Division".

Insert instead “Equity Division for entry in the Commercial List".
