s1 3 s4 Suppression of Gambling Act 1895 SUPPRESSION OF GAMBLING ACT 1895 [as amended by all amendments that commenced on or before 1 March 1996] An Act for the suppression of gambling PART 1—PRELIMINARY 1 Short title This Act may be cited as the Suppression of Gambling Act 1895 . 4 Interpretation In this Act— “lottery” means any scheme or device for the sale, gift, disposal, or distribution of any property depending upon or to be determined by lot or chance, whether by the throwing or casting of any dice or the drawing of any tickets, cards, lots, numbers or figures, or by means of any wheel or trained animal, or otherwise howsoever. “place” means any house, office, room, tent, resort, or other place in or out of an enclosed building, vessel, or premises, whether upon land or water, whether private property or otherwise, and any vehicle, and includes any place declared by the Governor in Council by order in council to be a “place” for the purposes of this Act. “property” means any real or personal property whatsoever, whether situate or being within or without the State, or of any right thereto or share or interest therein. “vehicle” means any car, tramcar, railway carriage, carriage, drag, wagon, cart, truck, handcart, barrow, bicycle, tricycle, motor cycle, motor car, motor vehicles, and any vehicle of any kind whatsoever.
s5 4 s9 Suppression of Gambling Act 1895 PART 2—LOTTERIES 5 Unlawful to establish, commence, be a partner in etc. any lottery It shall be unlawful to establish, commence, or be a partner in, or to manage or conduct, or assist in managing or conducting, any lottery. 6 Unlawful to sell tickets for any lottery It shall be unlawful to sell or dispose of or to endeavour to sell or dispose of any ticket or other means by which permission or authority is gained or given to any person to throw for, compete, or have any interest in any lottery. 7 Unlawful to sell or dispose of etc. any property by lottery It shall be unlawful to sell or dispose of, or endeavour to sell or dispose of, or agree or promise, whether with or without consideration, to sell or dispose of any property by lottery. 8 Sweeps etc. unlawful Every transaction wherein any money or other property is received as or for the consideration for any assurance, undertaking, promise, or agreement, express or implied, to pay, give, or distribute thereafter to or among any person or persons by lottery any money or other property on any event or contingency whatsoever, or as or for the consideration of securing the paying, giving, or distributing by some other person of any money or other property on any event or contingency whatsoever, and every scheme of the nature commonly knows as a ‘sweep’ or ‘consultation’, shall be deemed to be a lottery within the meaning of this Act. 9 Missing-word competition etc. unlawful Every transaction wherein any property is received as or for the consideration for any assurance, undertaking, promise, or agreement, express or implied, to pay, give, or distribute thereafter any money or other property to or among any person or persons who shall successfully guess or otherwise by chance find out, supply, or fill in a word, letter, figure, or
s 10 5 s 14 Suppression of Gambling Act 1895 number omitted from any sentence or part of a sentence, paragraph or part of a paragraph whatsoever, or as or for the consideration of securing the giving or distributing by some other person of any money or other property on any such event or contingency as aforesaid, and every scheme of the nature commonly known as a ‘missing-word’ competition, shall be deemed to be a lottery within the meaning of this Act. 10 Unlawful to print or publish ticket for or otherwise advertise unlawful lottery (1) It shall be unlawful to publish or cause to be published by means of radio broadcast or television, or to print, publish, or exhibit, or to cause to be printed, published, or exhibited, any ticket for, or any advertisement, sign, or other notice of or relating to, the drawing or intended drawing of any unlawful lottery, or of or for the sale of any ticket or chance of or in any such lottery, or concerning or in any manner relating to such lotteries in general, or to any such particular lottery or to any ticket, chance, or share thereof or therein. (2) In this section— “unlawful lottery” means any lottery which is not declared by any Act to be lawful, and includes any foreign art union within the meaning of the Art Union Regulation Act 1964 . 11 Penalty Any person who offends against any of the foregoing provisions of this Act shall be liable, on conviction, to 6 months imprisonment, or to a fine not exceeding $200. 14 What this Act does not apply to Nothing herein contained shall be deemed or construed to repeal, alter, or in any way affect the Totalisator Restriction Act 1889 .
s 32 6 s 34 Suppression of Gambling Act 1895 PART 5—GENERAL 32 On neglect to prosecute any summons justices may authorise some other person to proceed In case any person who shall have laid any complaint in respect of any offence against this Act shall not appear at the time at which the defendant shall have been summoned to appear, or at any time to which the hearing of the summons may have been adjourned, or if such person, in the opinion of any justices having authority to adjudicate with respect to the offence charged in such complaint as aforesaid, shall otherwise have neglected to proceed upon or prosecute such complaint with due diligence, it shall be lawful for such justices to authorise any other person to proceed on such complaint and summons instead of the person to whom the same may have been granted, or such justices may dismiss the first complaint and summons, and authorise any person to lay a fresh complaint in respect of the offence charged in such first complaint in like manner as if the previous summons had not been granted. 34 Distress not unlawful for want of form When any distress shall be made for any money to be levied by virtue of the warrant of any justice under this Act, the distress shall not be deemed unlawful, nor shall any party making the same be deemed a trespasser, on account of any defect or want of form in the complaint, summons, or warrant of apprehension, conviction, warrant of distress, or other proceeding relating thereto; nor shall such party be deemed a trespasser from the beginning on account of any irregularity which shall be afterwards committed by the party, but all persons aggrieved by such defect or irregularity may recover full satisfaction for the special damage by action in any of Her Majesty’s courts of record.
