An Act to prohibit the supply of In toxicat ing

Liquors to the Aboriginal Natives of New

South Wales. [23rd, December, 1867.]

WH E R E A S Abor ig ina l Na t ives of N e w Sou th W a l e s is p roduct ive of

t h e supp ly ing of I n t o x i c a t i n g L iquors to t h e

serious mischief to t h e said Abor ig ina l Nat ives a n d is t h e cause of

n u m e r o u s cr imes agains t life a n d p rope r ty A n d whereas i t is

expedient to prohib i t t h e supply ing of such In tox ica t ing Liquors as

aforesaid Be i t therefore enac ted b y t h e Queen ' s Mos t Exce l l en t

Majes ty by a n d w i t h t he advice and consent of t h e Legis la t ive Counci l

a n d Legis la t ive Assembly of N e w Sou th W a l e s in P a r l i a m e n t

assembled a n d by t h e au tho r i t y of t h e same as fo l lows:—

1. I f any pe r son w h e t h e r l icensed or unl icensed shal l sell

supply or give any L iquor fe rmented or sp i r i tuous or any mixed L i q u o r

pa r t ly fe rmented or pa r t ly spi r i tuous to any Abor ig ina l Na t i ve of N e w

South W a l e s h e shal l for every such offence forfeit a n d pay a pena l ty

n o t exceeding t e n pounds	A n d if such L i q u o r be supplied by a n
unl icensed person such pena l ty shall be over	a n d above a n y pena l ty

to wh ich such person m a y be l iable for sel l ing L i q u o r w i thou t a l icense

P rov ided t h a t n o t h i n g here in conta ined shal l p r even t t h e supply of

a n y of t h e said L iquo r s to a n y Abor ig ina l for medic ina l purposes only.

2. Eve ry pena l ty for a n y offence aga ins t t h i s A c t m a y be

recovered before a n y two Jus t i ces of t h e Peace in a s u m m a r y w a y a n d

if t h e same be no t pa id wi th in t h e t ime l imited by such Jus t ices i t shal l be levied by dis tress and sale of t h e offender's goods a n d on failure of distress shal l be enforced in m a n n e r provided by t h e A c t

of L iquo r s to Aborigines P reven t ion A c t . "
