AN ACT for the closure of portions of certain Roads.

[Assented to 6th January, 1930.]

this present Parliament assembled, and by the authority of

the same, as follows:—

1. This Act may be cited as the Roads Closure Act (No. 2), Short title.

1929.

2. (1.) Subject as hereinafter provided, those portions of =croft,: =: ores.

Nelson crescent and Nelson avenue in the City of Perth as sent and

described in Parts 1 and 2 of the First Schedule hereto may be closed by Proclamation, and thereafter all rights of way over such portions of roads shall cease, and the soil thereof shall be revested in His Majesty as of his former estate : Pro- vided that such Proclamation shall not be published until the land described in Parts 1, 2, and 3 of the Second Schedule hereto shall have been surrendered to His Majesty and pro- claimed as public roads (additions to).

(2.) Upon the land comprised in Parts 1, 2, and 3 of the Second Schedule hereto being surrendered to His Majesty and proclaimed as public roads, the land comprised in Parts 1 and 2 of the First Schedule may be granted in fee simple in exchange for the land so surrendered.

North Fremantte	3. That portion of Thompson road in the Municipal Dis.. trict of North Fremantle, lying between the production east- ward of the northern and southern boundaries of subdivi- sional lot 12 of North Fremantle lot P105, is closed, and all
rights of way over the same shall cease on the passing of this
Act.

of Fraser street,	4. That portion of:Fraser *street iu the Municipal District of Claremont lying east of Derby street is hereby closed, and all rights of way over the same shall cease on the passing of this Act.

Closure of portion 5. That portion of Morrison crescen in the Midland

Midland Junction. Junction Municipal District lying between the production

north of the west boundary of , subdivisional lot 38 of Swan

location 7 and the Production north of the west side 'of Vivo- ash street, as shown on deposited Diagram No. 8514, is hereby closed, and all rights of way over the same shall cease on the passing of this Act.

of Marquis street, 6. That portion of Dyer street in the City of Perth situate

and other streets.	eastward of a line extending 200° 48' from a. point on its north side situate 638 2/1.0th links from its intersection with the eastern side of Havelock street; also Marquis street and the whole of Prince, Elm, Oak, and Dudley streets in the City of Perth, as shown on deposited Plans No. 494 and No. 457, are hereby closed, and all rights of way over the same shall cease on the passing of this Act.
Provided that this section shall not come into operation until proclaimed.

FIRST SCHEDULE.

PART 1.

That portion of Nelson crescent and Nelson avenue bounded by lines starting from the south corner of Perth town lot T18 and extending 139° 8' 99 3/10th links along the south-western boundary of lot 569 to the tangent point of a circular curve the bearing and length of whose radius are 230° 14' and 63 1/10th links from said tangent point; thence by said curve southerly 66 9/10th links along part of the western boundary of sub lot 410 to the tangent point of a circular curve the bearing and length of whose radius are. 110° 58"and 200 links from said'tangent point ; thence by said curve south- erly J. chain 17 4/10th links again along part of said western boundary to its .

intersection with a circular curve the bearing and length .of whose-radius are. 200° 58' and 1 chain 44 links from its western tangent point, thence by saidthence. curve westerly 5 9/leth links to, said father* . point, thence 290° 58'

27 2/10th links to the tangent point of a circular curve the bearing and length of whose radius are 200° 58' and 1 chain 44 links from said tangent point, thence by said curve westerly 92 7/10th links to the tangent point of a circular curve the bearing and distance of whose radius are 164° 5' and 3 chains 33 links from said tangent point, thence by said curve westerly 2 3/10th links to a circular curve the bearing and length of whose radius are 331° and 15 chains 81 links from its western tangent point, and thence by said curve north-easterly 2 chains 95 2/10th links along part of the south- eastern boundary of lot T20 and the south-eastern boundary of lot. T19 to the starting point.

PART 2.

That portion of Nelson crescent bounded by lines starting from a point on the south-eastern boundary of Perth town lot T21 situate 7 links fi• nh its southern corner, and extending north-easterly 35 2/10th links along said boundary to its intersection with a circular curve the bearing and length of whose radius are 342° 29' and 1 chain 51 5/10th links from its south-Western tangent point, and thence by said curve south westerly 35 3/10th links to the starting point.

All bearings being true or thereabouts and the measurements more or less.

SECOND SCHEDULE.

PART 1.

Those portions of Perth town lots T20 and T21, containing about 8/10ths of a perch, bounded by lines starting from a point on the south-eastern boun- dary of lot T21 aforesaid situate 42 3/10th links from its southern corner, and extending north-easterly 1 chain 12 6/10th links along said boundary by a. circular curve the bearing and length of whose radius are 331° and 15 chains 81 links from its western tangent point to the tangent point of a circular curve the bearing and length of whose radius arc 163° 42' and 2 chains 94 1/10th links from said tangent point, thence by said curve south- westerly 1 chain 2 links to the tangent point of a circular curve the bearing and length of whose radius are 324° 59' and 1 chain 51 5/10th links from said tangent point, and thence by said curve south-westerly 11 1/10th links to the starting point.

All bearings being true or thereabouts and the measurements move or less.

PART 2.

That portion of Perth town lot T26 containing about 1 perch, bounded by lines starting from the intersection of the northern side of Nelson crescent with the western side of Hale street and extending 354° 6' 50 9/10th links along said side of street to the tangent point of a circular curve the bear- ing and length of whose radius are 264° 6' and 50 links from said tangent point, thence by said curve south-westerly 77 2/10th links to the northern side of Nelson crescent aforesaid, and thence easterly 50 9/10th links along said side by a circular curve the bearing and length of whose radius are 331° and 15 chains 8:L links from its western tangent point to the starting point.

That portion of Perth sub lot 410 containing about 7 3/10th perches bounded by lines starting from a point on the western boundary of said lot situate 180° 1 chain 78 1/10th links and 90° 2 links from the southernmost corner of lot 569, and extending south-easterly 86 7/10th links by a circular curve the bearing and length of whose radius are 203° 19' and 1 chain 44 links from said starting point to the tangent point of a circular curve the bearing and length of whose radius are 237° 50' and 3 chains 33 3/10th links from said tangent point, thence by said curve 32 6/lOth links to the tangent point of a circular curve the bearing and length of whose radius are 63° 26' and 1 chain 51 5/10th links from said tangent point; thence by said curve 1 chain 12 3/10th links to the south-western boundary of sub lot 410 afore- said; thence 290° 57' 41 3/10th links along said boundary to the tangent point of a circular curve the bearing and length of whose radius are 20° 57' and 2 chains from said tangent point, and thence by said curve north- westerly 1 chain 96 8/10th links, again along part of said south-western boundary to the starting point.
