(Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Supply and Development Act 1939.

Principal Regulations

1. In these Regulations, “Principal Regulations” means the Supply and Development Regulations.

Repeal of regulations 2, 3 and 4

2.Regulations 2, 3 and 4 of the Principal Regulations are repealed.

Interpretation

3. Regulation 5 of the Principal Regulations is amended:

(a) by omitting the definition of “employee” and substituting the following definitions:

“ ‘employee’ means a person employed under subsection 10 (1) of the Act;

‘Manager’ means a person holding, or for the time being performing the duties of, the office or position of manager of an undertaking;”;

(b) by omitting the definition of “officer”;

(c) by omitting from the definition of “the Act” “1939-1948,and, if that Act is at any time amended, includes that Act as so amended” and substituting “1939”; and

(d) by omitting the definition of “the Secretary”.

Powers of Minister

4. Regulation 8 of the Principal Regulations is amended by omitting paragraph (1) (a).

Contracts for defence purposes

5. Regulation 9 of the Principal Regulations is amended by omitting “and the execution of such contracts and agreements as are” and substituting “as is”.

Repeal of regulations 12 and 38

6. Regulations 12 and 38 of the Principal Regulations are repealed.

7. Regulation 39 of the Principal Regulations is repealed and the following regulation substituted:

Manager subject to Board or Administrator

“39. The Manager of an undertaking is subject, in the performance of his or her duties, to the control and direction of the Board or the Administrator (as the case may be)”.

Power to delegate

8. Regulation 40 of the Principal Regulations is amended:

(a) by omitting from subregulation (1) “person appointed in pursuance of the last preceding regulation,” and substituting “Manager”; and

(b) by inserting in subregulation (1) “or her” after “his” (wherever occurring).

Functions of Manager

9. Regulation 42 of the Principal Regulations is amended:

(a) by omitting from subregulation (1) “(1)”;

(b) by inserting in subregulation (1) “or her” after “his” (wherever occurring); and

(c) by omitting paragraphs (1) (a) and (b) and subregulations (2) and (3).

Furlough

10. Regulation 78 of the Principal Regulations is repealed.

Repeal of First Schedule

11. The First Schedule to the Principal Regulations is repealed.
