SUPPLY AND DEVELOPMENT ACT 1939 - PART I PART I-PRELIMINARY
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 1 Short title
SECT
1. This Act may be cited as the Supply and Development Act 1939.*1*
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 2 Commencement
SECT
2. This Act shall come into operation on the day on which it
receives the Royal Assent.*1*
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 4 Interpretation
SECT
4. In this Act, unless the contrary intention appears:
"Australia" includes the external Territories;
"Commonwealth authority" means a company or other body corporate
incorporated under a law of the Commonwealth or of a State or
Territory, being a company or body corporate in which the Commonwealth
has a controlling interest;
"Defence Act" means the Defence Act 1903;
"goods" includes all kinds of personal property, and also includes
anything growing in or on land and mineral or other deposits;
"industrial award" means an industrial award as defined in
subsection 7 (1) of the Public Service Act 1922;
"long range weapons" means weapons which are capable of, or intended
for, use in warfare and are controlled, directed or released in flight
by external or internal means or both, and includes prototypes used in
the development of such weapons;
"officer" means an officer as defined in subsection 7 (1) of the
Public Service Act 1922;
"Secretary" means the Secretary to the Department;
"time of war" means any time during which a state of war exists, and
includes the time between the issue of a Proclamation of the existence
of war or danger thereof and the issue of a Proclamation declaring
that the war or danger thereof declared in the prior Proclamation no
longer exists;
"undertaking" means a building, depot, establishment, factory,
laboratory, magazine, range, observation post , store or works
maintained or operated by or on behalf of the Commonwealth for the
purposes of, or for purposes incidental to, the procurement, supply,
manufacture, testing or storage of war materiel;
"war" means any invasion or apprehended invasion of, or attack or
apprehended attack on, Australia by an enemy or armed force;
"war materiel" means armaments, weapons (including long range
weapons), ammunition, engines, magazines, aircraft, vehicles, merchant
ships and other marine craft, equipment, supplies, baggage and other
things needed in war and includes any goods, components, parts,
accessories or plant necessary for, or incidental to, the testing,
development, production or supply of any of those things.

SUPPLY AND DEVELOPMENT ACT 1939 - SECT 5 Functions of Department
SECT
5.*2* (1) The matters to be administered by the Department shall
include matters relating to arrangements for ascertaining costs and
for the control and limitation of profits in relation to the
production of war materiel, and, subject to the directions, in
writing, of the Governor-General and to subsection (2):
(a) the provision or supply of war materiel;
(b) the manufacture or assembly of aircraft or parts thereof by the
Commonwealth or any authority of the Commonwealth;
(c) arrangements for the establishment or extension of industries
for purposes of defence;
(e) the arrangement or co-ordination of:
(i) surveys of Australian industrial capacity and the preparation
of plans to ensure the effective operation of Australian industry in
time of war including plans for the decentralization of secondary
industries and particularly those relating to defence; and
(ii) the investigation and development of Australian sources of
supply of goods, which in the opinion of the Governor-General are
necessary for the economic security of Australia in time of war and,
in particular, the investigation and development of additional oil
resources, the production of power alcohol from sugar or other
vegetable crops, and the production of oil from coal or shale; and
(f) any matter incidental to a matter referred to in paragraph (a),
(b), (c) or (e).
(2) The Governor-General may, by instrument signed by the
Governor-General:
(a) add to or vary the matters to be administered by the Department;
and
(b) determine the extent to which, or the conditions upon which, any
matter may be administered by the Department.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 6 Information
SECT
6. (1) Where, in the opinion of the Governor-General, it is
necessary or desirable in the interests of the defence of the
Commonwealth that information should be obtained in relation to
industrial, commercial or other activities, or with respect to any
goods, the regulations may require such persons or classes of persons,
as are prescribed, to furnish, as prescribed, such information and
particulars, as are prescribed, with respect to those activities or
goods.
(2) Nothing in this Act shall authorize the making of any regulation
rendering it compulsory for any person to disclose any secret process
of manufacture.
(3) Any person who, when required by the regulations to furnish any
information or particulars, refuses or neglects so to do, shall be
guilty of an offence against this section.
(4) An offence against this section is an indictable offence and,
subject to subsections (5) and (6), is punishable on conviction by a
fine not exceeding $2,000 or imprisonment for a period not exceeding
12 months, or both.
(5) Notwithstanding that an offence against this section is an
indictable offence, a court of summary jurisdiction may hear and
determine proceedings in respect of such an offence if the court is
satisfied that it is proper to do so and the defendant and the
prosecutor consent.
(6) Where, in accordance with subsection (5), a court of summary
jurisdiction convicts a person of an offence against this section, the
penalty that the court may impose is a fine not exceeding $500 or
imprisonment for a period not exceeding 3 months, or both.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 7 Arrangements with State Governments as to execution of Act
SECT
7. (1) The Minister may make an arrangement with a Minister of a
State for and in relation to any matter necessary or convenient for
the purpose of carrying out or giving effect to this Act, and in
particular for:
(a) the execution by State officers of any power or duty conferred
or imposed on any officer under this Act or the regulations;
(b) the collection by any State Department or officer of any
information required for the purposes of this Act; and
(c) the supplying of information by any State Department or officer.
(2) All State officers executing any power or duty conferred or
imposed on any officer under this Act or the regulations, in pursuance
of any arrangement entered into under this section, shall, for the
purposes of the execution of that power or duty, be deemed to be
officers under this Act.
(3) In this section, "State" includes the Northern Territory.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 8 Advisory Committees
SECT
8. (1) The Minister may, in relation to all or any of the matters
specified in section 5, or in relation to such other matters as are
prescribed, constitute committees and appoint persons to be members of
those committees to advise the Minister.
(2) A committee constituted under this section shall exercise its
duties in accordance with the regulations or the directions of the
Minister.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 8A Remuneration and allowances of members of committees
SECT
8A. (1) The members of a committee constituted under section 8 shall
be paid such remuneration as is determined by the Remuneration
Tribunal, but, if no determination of that remuneration by the
Tribunal is in operation, they shall be paid remuneration at the rate
that was applicable immediately before the commencement of this
section.
(2) The members of a committee referred to in subsection (1) shall
be paid such allowances as are prescribed.
(3) This section has effect subject to the Remuneration Tribunal Act
1973-1974.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 9 Powers of Governor-General in relation to undertakings
SECT
9. The Governor-General may establish, maintain and operate, or
arrange for the establishment, maintenance and operation of,
undertakings.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 10 Employment of persons in connection with undertakings
SECT
10. (1) The Secretary may employ such persons as the Secretary
considers necessary in connection with any undertaking established by
the Governor-General under section 9.
(2) A person shall not be employed under subsection (1) for the
performance of work of a kind that the Public Service Board has
directed, in writing, is to be performed by persons appointed or
employed under the Public Service Act 1922.
(3) The Public Service Act 1922 does not apply in relation to
persons employed under subsection (1).
(4) The terms and conditions of employment of persons employed under
subsection (1) shall be as prescribed by, or determined in accordance
with, the regulations.
(5) A regulation, or a determination made under a regulation, made
for the purposes of subsection (4) may make provision for or in
relation to a matter by applying, adopting or incorporating, with or
without modification:
(a) any of the provisions of:
(i) an Act;
(ii) any regulations or rules made under an Act;
(iii) a determination made under section 82D of the Public Service
Act 1922;
(iv) an industrial award; or
(v) another determination made under a regulation made for the
purposes of subsection (4);
as in force at a particular time or as in force from time to time; or
(b) any matter contained in any other instrument or writing existing
at the time when the regulation or determination takes effect;
but a regulation, and a determination made under a regulation, made
for the purposes of subsection (4) shall not, except as provided by
this subsection, make provision for or in relation to a matter by
applying, adopting or incorporating any matter contained in an
instrument or other writing as in force from time to time.
(6) Nothing in this section affects the application of the Workplace
Relations Act 1996 in relation to persons employed under subsection
(1).
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 10A Transfer of persons where functions are to be performed by a Commonwealth authority
SECT
10A. (1) Where the Minister certifies in writing that a function
that has been performed by persons employed under subsection 10 (1) is
to be performed by a Commonwealth authority, the Secretary may, by
writing published in the Gazette, declare that specified persons or
classes of persons are in the employment of the Commonwealth
authority.
(2) A person specified in, or included in a class of persons
specified in, a declaration under subsection (1):
(a) on the day specified in the declaration for the purpose of this
subsection, ceases to be employed under subsection 10 (1); and
(b) from and including that day, is employed by the Commonwealth
authority specified in the declaration.
(3) For the purpose of facilitating a transfer of persons to the
employment of a Commonwealth authority, the Commonwealth authority
may, notwithstanding anything in any other law (other than an
industrial award), determine special terms or conditions of employment
that are to apply in relation to the persons (other than terms and
conditions with respect to superannuation).
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 11 Existing officers and employees
SECT
11. (1) A person who, immediately prior to the commencement of this
Act, was employed in a civil capacity under the Defence Act, and who
is a person or one of a class of persons specified, for the purposes
of this section, by the Minister for Supply and Development and the
Minister for Defence by notice published in the Gazette, shall, by the
force of this Act, cease to be employed under the Defence Act and be
employed in the Department, and shall be deemed to have been engaged
in pursuance of this Act.
(2) A person who, immediately prior to the commencement of this
subsection, was employed in the Department of Munitions under or by
virtue of the National Security (Munitions) Regulations or the
National Security (Shipbuilding) Regulations, and who is a person or
one of a class of persons specified for the purpose of this subsection
by the Minister by notice published in the Gazette, shall, upon the
date of the publication of the notice, cease to be employed in that
Department, and shall be deemed to be employed under this Act.*3*
(3) All officers and employees specified in this section shall
preserve all their existing and accruing rights.
(4) For the purposes of this section, the expression "existing and
accruing rights", in relation to any officer or employee, means rights
in respect of:
(a) leave on the ground of illness;
(b) long service leave or pay in lieu thereof (including pay to
dependants on the death of the officer or employee);
(c) superannuation; and
(e) in the case of a female officer or employee, payment on
marriage, to which from time to time the officer or employee would be
entitled if he had remained an officer or employee of the Defence
Department, or the Department of Munitions, as the case may be.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 12 Transfer of establishments
SECT
12. (1) All factories established under section 63 of the Defence
Act, which were maintained under that Act immediately prior to the
commencement of this Act, and which are specified for the purposes of
this section by the Governor-General by order published in the
Gazette, shall, by force of this Act, cease to be maintained under the
Defence Act and shall be deemed to have been established by the
Governor-General in pursuance of this Act.
(2) All factories established under the National Security
(Munitions) Regulations, and operated or maintained under those
regulations immediately prior to the commencement of this subsection,
shall be deemed to have been established under this Act.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 14 Suspension of certain powers under Defence Act
SECT
14. During the continuance in operation of this Act, the powers
conferred by paragraphs 63 (1) (d) and (da) of the Defence Act shall
not be exercised, and the powers conferred by paragraphs 63 (1) (db)
and (f) of that Act shall not be exercised in relation to any factory
deemed to have been established in pursuance of this Act or, unless
the Governor-General otherwise directs in writing in relation to any
matter specified in this Act.

SUPPLY AND DEVELOPMENT ACT 1939 - SECT 25 Officers and employees to observe secrecy
SECT
25. An officer or employee of the Department, a member of a
committee or of a Board constituted under this Act, a person
performing any duty or function in relation to any matter specified in
or arising under this Act or any regulation made under, or in force by
virtue of, this Act and an officer of the Commonwealth or a State to
whom information furnished in pursuance of this Act has been disclosed
by virtue of his official position, shall not, except as allowed by
this Act or the regulations, divulge any information or particulars
furnished in pursuance of this Act or the regulations.
Penalty: $500 or imprisonment for 3 months or both.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 25A Liability of officers and employees
SECT
25A. (1) An officer or employee of the Department, a member of a
committee or of a Board constituted under this Act or any regulation
made under or in force by virtue of this Act, or a person engaged or
employed to perform any duty or function in relation to any matter
specified in, or arising under, this Act or any such regulation, shall
not be under any liability, civil or criminal, in respect of any act
or thing done by him in the course of his duty, unless it is shown
that he acted negligently or without reasonable care in the doing of
that act or thing.
(2) Nothing in this section shall prevent any claim being made, or
any action or suit being brought, against the Commonwealth.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 26 Requirements of Tariff Board Act not affected
SECT
26. Nothing in this Act or the regulations shall be construed as
being in derogation of any requirement of the Tariff Board Act
1921-1934.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 26A Delegation by Secretary
SECT
26A. (1) The Secretary may, either generally or as otherwise
provided by the instrument of delegation, by writing, delegate to an
officer all or any of his or her powers under this Act, other than
this power of delegation.
(2) A power delegated under subsection (1) shall, when exercised by
the delegate, be deemed to have been exercised by the Secretary.
(3) The delegate is, in the exercise of a power delegated under
subsection (1), subject to the directions of the Secretary.
(4) The delegation of a power under subsection (1) does not prevent
the exercise of the power by the Secretary.
SUPPLY AND DEVELOPMENT ACT 1939 - SECT 27 Regulations
SECT
27. (1) The Governor-General may make regulations, not inconsistent
with this Act, prescribing all matters which by this Act are required
or permitted to be prescribed or which are necessary or convenient to
be prescribed for carrying out or giving effect to this Act and in
particular for prescribing matters providing for or in relation to:
(a) the matters specified in section 5;
(b) the establishment, maintenance or operation of undertakings;
(ba) the appointment of boards for the administration of
undertakings established in pursuance of this Act, and the powers and
functions of any such board;
(bb) the taking of safety measures against risks arising from the
operation of any undertakings;
(bc) the taking of measures in relation to any undertaking for the
protection of property of the Commonwealth including search of persons
entering, or seeking to enter, or being within the premises assigned
to any undertaking;
(bd) the entry upon and the use on behalf of Australia of any area
of land or water (including any area owned or held in right of the
Commonwealth or of a State or a Territory for the purpose of any
undertaking;
(be) the declaration as a prohibited area of any place (including
any place owned or held in right of the Commonwealth or of a State or
a Territory) used or intended to be used for the purpose of an
undertaking and the prohibition of any person entering, being or
remaining in the prohibited area without permission and the removal of
any such person from the area;
(bf) the carrying out of such work and the making and execution of
such contracts and agreements as are necessary or expedient in the
interests of defence;
(bg) the requisitioning or compulsory acquisition of any minerals or
other goods required for purposes of defence;
(bh) the building, repair and maintenance of merchant ships and the
building, extension, operation, repair and maintenance of shipyards,
dry-docking and repair facilities for merchant ships;
(bj) the payment of compensation for any loss, injury or damage
suffered by any person by reason of anything done in pursuance of
regulations providing for the matters specified in paragraphs (bd),
(be) and (bg);
(d) the powers of officers and persons for the purposes of the
regulations; and
(e) penalties not exceeding $500 or imprisonment for 3 months or
both for breaches of the regulations.
(2) This section shall not be construed to empower the making of
regulations:
(a) depriving a trade union or any member of a trade union of any
right conferred by any law of the Commonwealth or of a State or
Territory relating to rates of wages or conditions of employment;
(b) altering or affecting, to the detriment of a trade union or any
member of a trade union, any provision of an agreement between an
employer and the trade union relating to rates of wages or conditions
of employment;
(c) restricting the freedom of any employee to change his
employment;
(d) altering to the detriment of any employees, or any trade union,
any rule, practice, or custom in any industry; or
(e) affecting the rules of any trade union.
(3) In this section:
"employee" does not include a person who is an officer;
"member of a trade union" does not include any member of a trade
union who is not an employee;
"trade union" includes any organization registered under a law of
the Commonwealth or of a State or Territory and a branch of any such
organization.

(a) Certain amendments effected by the Supply and Development Act
1948 were deemed to have commenced on 6 April 1948. See notes 2 and 3
below.
(b) The Supply and Development Act 1939 was amended by Part V
(sections 97-102) of the Defence Force Re-organization Act 1975,
section 2 of which provides as follows:
"2. This Part shall come into operation on the day on which this Act
receives the Royal Assent, and the remaining provisions of this Act
shall come into operation on such date as is, or such respective dates
as are, fixed by Proclamation."
(c) By virtue of subsection 2 (7) of the Administrative Changes
(Consequential Provisions) Act 1976 the amendment made by that Act to
the Supply and Development Act 1939 is deemed to have come into
operation on 22 December 1975."
(d) The Supply and Development Act 1939 was amended by Part LXXVII
(section 280) only of the Statute Law (Miscellaneous Amendments) Act
(No. 2) 1982, subsection 2 (1) of which provides as follows:
"(1) Sections 1, 2, 166 and 195 and Parts III, VI, VII, XVI, XXXVI,
XLIV, LI, LIII, LIV, LXI and LXXVII shall come into operation on the
day on which this Act receives the Royal Assent."
(e) The Supply and Development Act 1939 was amended by section 3
only of the Statute Law (Miscellaneous Provisions) Act (No. 1) 1985,
subsection 2 (1) of which provides as follows:
"(1) Subject to this section, this Act shall come into operation on
the twenty-eighth day after the day on which it receives the Royal
Assent."
(f) The Statute Law (Miscellaneous Provisions) Act (No. 1) 1985 was
amended by section 3 only of the Statute Law (Miscellaneous
Provisions) Act (No. 2) 1985, paragraph 2 (15) (b) of which provides
as follows:
"(15) The amendments of the Statute Law (Miscellaneous Provisions)
Act (No. 1) 1985 as made by this Act shall be deemed to have come into
operation:
(b) in the case of the other amendments-on the twenty-eighth day
after the day on which that Act received the Royal Assent."
(g) The Supply and Development Act 1939 was amended by Part X
(sections 75-78) only of the Defence Legislation Amendment Act 1987,
subsection 2 (1) of which provides as follows:
"(1) Sections 1, 2, 3, 9 and 10, subsection 13 (1), sections 23, 24
and 25, subsection 26 (1), sections 27, 29, 31, 33, 34, 35, 36, 42,
43, 44, 45, 52, 53, 54, 55 and 58, subsection 61 (1), section 62,
subsection 69 (1) and Parts IX and X shall come into operation on the
day on which this Act receives the Royal Assent."
(h) The Supply and Development Act 1939 was amended by Schedule 4
(item 144) only of the Statute Law Revision Act 1996, subsection 2 (1)
of which provides as follows:
"(1) Subject to subsections (2) and (3), this Act commences on the
day on which it receives the Royal Assent."
(i) The Supply and Development Act 1939 was amended by Schedule 19
(item 52) only of the Workplace Relations and Other Legislation
Amendment Act 1996, subsection 2 (1) of which provides as follows:
"(1) Subject to this section, this Act commences on the day on which
it receives the Royal Assent."

SUPPLY AND DEVELOPMENT ACT 1939 - NOTE 2
*2* Section 5 was amended by subsection 6 (1) of the Supply and
Development Act 1948. Subsection 6 (2) of that Act provides as
follows:
"(2) The amendments effected by paragraphs (a) and (e) of the last
preceding subsection shall be deemed to have come into operation on
the sixth day of April One thousand nine hundred and forty-eight."

*3* Subsection 11 (2) was substituted by paragraph 10 (1) (a) of the
Supply and Development Act 1948. Subsection 10 (2) of that Act
provides as follows:
