Supply Act (No. 2) 1990-91 (Cth)

BE IT ENACTED by the Queen, and the Senate and the House of Representatives of the Commonwealth of Australia, as follows:
1. This Act may be cited as theSupply Act (No. 2) 1990-91.

Except where the contrary intention appears in Schedule 2, amounts issued by the Minister for Finance under subsection (1) in respect of services described in Schedule 2 as Capital Works and Services may be applied only for purposes of a kind for which money appropriated in respect of services so described in an Act appropriating money, otherwise than by way of interim provision, for expenditure in respect of the financial year ending on 30 June 1990 could lawfully have been applied.
Except where the contrary intention appears in Schedule 2, amounts issued by the Minister for Finance under subsection (1) in respect of payments to or for the States, the Northern Territory and the Australian Capital Territory may be applied only in making payments to or for the States, the Northern Territory and the Australian Capital Territory of a kind that could lawfully have been made out of money appropriated for payments to or for the States, the Northern Territory and the Australian Capital Territory in an Act appropriating money, otherwise than by way of interim provision, for expenditure in respect of the financial year ending on 30 June 1990.
The Consolidated Revenue Fund is appropriated to the extent necessary for the purposes of subsection (1).
“Appropriation Act” means an Act appropriating money for expenditure in respect of a financial year and includes an Act appropriating money, by way of interim provision, for such expenditure.
(a) on such terms and conditions (if any) as are from time to time determined, in writing, for the purposes of Appropriation Acts, by the Minister specified in column 4 opposite to that item number, as being terms and conditions applicable to payments under such Acts to a State for that purpose; and
(b) in such amounts and at such times as are determined, in writing, by the Minister specified in column 5 opposite to that item number.
(a) on such terms and conditions; and
(b) in such amounts and at such times;
as the Commonwealth determines.
(a) this Act has effect, on and after the commencement of the provisions establishing the Grants Program, as if:
(i) the amounts appropriated under subdivisions 1 and 2 of Division 812 in Schedule 2 to this Act were each reduced by such respective amounts as are determined by the Minister, in writing, for the purpose; and
(ii) the amount in subdivision 1 of Division 812 as so reduced were appropriated not only for the purpose specified in that subdivision but also for the purpose of making grants to the States under the Grants Program; and
(iii) the amount in subdivision 2 of Division 812 as so reduced were appropriated not only for the purpose specified in that subdivision but also for the purpose of making grants to the Australian Capital Territory and the Northern Territory under the Grants Program; and
(iv) each amount in this Act that includes the amount appropriated in subdivision 1 or 2 of Division 812 were reduced by the amount determined by the Minister under subparagraph (a) (i) in respect of that subdivision; and
(b) the
Supply Act (No. 1) 1990-91 has effect, on and after the commencement of the provisions establishing the Grants Program, as if:(i) an amount equal to the total of the amounts determined by the Minister under subparagraph (a) (i) had been appropriated to the Department of the Arts, Sport, the Environment, Tourism and Territories under a new subdivision 12 of Division 135 of the Schedule to that Act for the purpose of making grants, otherwise than to States or internal Territories, under the National Estate Grants Program; and
(ii) each amount in that Act that includes the amount appropriated under Division 135 were increased by an amount equal to the total of the amounts so determined.
(a) the purpose of payments (including advances) under Acts administered as part of the program; and
(b) other purposes of the program, being purposes for which appropriation has been made in an earlier Act.
