Supply Act (No. 2) 1983-84

An Act to make
interim provision for the appropriation of moneys out of the Consolidated
Revenue Fund for certain expenditure in respect of the year ending on 30 June
1984

BE IT ENACTED by
the Queen, and the Senate and the House of Representatives of the Commonwealth
of Australia, as follows:
Short title
1. This Act may be cited as the Supply
Act (No. 2) 1983-84.
Commencement
2.This Act shall come into operation
on the day on which it receives the Royal Assent.
Issue, application and appropriation of $998,737,000
3.(1) The Minister for
Finance may issue out of the Consolidated Revenue Fund and apply for the
services specified in the Schedule in respect of the financial year ending on
30 June 1984 the sum of $998,737,000.
(2)
Except where the contrary intention appears in the Schedule, amounts issued by
the Minister for Finance under sub-section (1) in respect of services described
in the Schedule as Capital Works and Services may be applied only for purposes
of a kind for which moneys appropriated in respect of services so

described in an Act appropriating moneys, otherwise
than by way of interim provision, for expenditure in respect of the financial
year ending on 30 June 1983 could lawfully have been applied.
(3)Except where the contrary intention
appears in the Schedule, amounts issued by the Minister for Finance under
sub-section (1) in respect of payments to or for the States and the Northern
Territory may be applied only in making payments to or for the States and the
Northern Territory of a kind that could lawfully have been made out of moneys
appropriated for payments to or for the States and the Northern Territory in an
Act appropriating moneys, otherwise than by way of interim provision, for
expenditure in respect of the financial year ending on 30 June 1983.
(4)The Consolidated Revenue Fund is
appropriated to the extent necessary for the purposes of sub-section (1).
Payments to States and Northern Territory
4.(1) Payments to a
State or the Northern Territory in respect of natural disaster relief and
restoration out of such of the moneys appropriated by this Act as are specified
in Division 865 in the Schedule shall be made—
- (a)
on such terms and conditions as are from
time to time determined by the Minister for Finance as being terms and
conditions applicable to payments to or for the States or the Northern
Territory for natural disaster relief and restoration; and
- (b)
in accordance with any determinations of
the Minister for Finance as to the amounts and times of payments.
(2) Payments to a State in respect of
supplementary assistance for apple and pear exports out of such of the moneys
appropriated by this Act as are specified in Division 932 in the Schedule shall
be made—
- (a)
on such terms and conditions as are from
time to time determined by the Minister for Primary Industry as being the terms
and conditions applicable to payments to or for the States for supplementary
assistance for apple and pear exports; and
- (b)
in accordance with any determinations of
the Minister for Primary Industry as to the amounts and times of payments.
(3) Payments to Tasmania in respect of the
construction of the second Hobart Bridge out of such of the moneys appropriated
by this Act as are specified in Division 973 in the Schedule shall be made—
- (a)
on such terms and conditions as are from
time to time determined by the Minister for Transport as being the terms and
conditions applicable to payments to or for Tasmania for the construction of
the second Hobart Bridge; and
- (b)
in accordance with any determinations of
the Minister for Finance as to the amounts and times of payments.
Australian Broadcasting Corporation
5.A reference in the Schedule to the
Australian Broadcasting Commission shall, after the commencement of the Australian
Broadcasting Corporation Act 1983, be read as including a reference to the
Australian Broadcasting Corporation.
