An Ordinance to amend the Supervision of Offenders (Community Service Orders) Ordinance 1985

Short title

1.  This Ordinance may be cited as the Supervision of Offenders (Community Service Orders) (Amendment) Ordinance 1985.¹

Performance and supervision of work

2.  Section 6 of the Supervision of Offenders (Community Service Orders) Ordinance 1985²  is amended—

(a)by inserting after sub-section (2) the following sub-section:

“(2A)  Before giving directions to an offender pursuant to sub-section (1), an authorized officer shall consult the offender in relation to the nature of the work to be performed by the offender pursuant to the relevant community service order.”;

(b)by omitting from sub-section (3) “, as far as practicable”;

(c)by omitting from paragraph (3) (a) “and”;

(d)by inserting after paragraph (3) (a) the following paragraph:

“(aa)take into account any matters raised by the offender in the course of consultation pursuant to sub-section (2A); and”; and

(e)by inserting in paragraph 3 (b) “as far as practicable, “before “avoid”.
