Superannuation Supervisory Levy Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Supervisory Levy Act 1991.

1.   Amendment

1.1   The Superannuation Supervisory Levy Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Regulation 3 (Interpretation)

2.1   Definition of “levy payer”:

Omit the definition, substitute:

“‘levy payer’ means a person who is liable under section 15DA of the Superannuation Entities (Taxation) Act 1987 to pay a levy;”.

3.   Regulation 4 (Basic levy amount)

3.1   Paragraph 4 (1) (a):

Omit the paragraph.

3.2   Paragraph 4 (1) (c):

Omit “within the meaning of the Occupational Superannuation Standards Act 1987”.

3.3   Paragraph 4 (2) (b):

Omit “financial year”, substitute “year of income”.

4.  Application of amendments

4.1   The amendments made by these Regulations apply to returns for the 1994-95 year of income and later years of income.
