This regulation may be cited as the Superannuation (State Public Sector) Variation of Deed Regulation (No. 1) 1994 . ˙ Amended Deed 2. The variation of the Deed of the State Public Sector Superannuation Scheme in the Schedule is approved.

3 Superannuation (State Public Sector) Variation of Deed (No. 1) No. 71, 1994 SCHEDULE VARIATION OF THE DEED OF THE STATE PUBLIC SECTOR SUPERANNUATION SCHEME section 2 ˙ Amendment of cl 1.4 (Meaning of Terms) 1. Clause 1.4(b) (definition “Smoothed Earning Rate”)— omit, insert— ‘ “smoothed earning rate” means a rate of interest, decided by the Board after receiving appropriate advice, that reasonably reflects the after tax earnings derived from the investment of member contributions to the fund, having regard to— (a) the cost of administering the fund; and (b) the charges incurred in the investment of member contributions; and (c) the allocation to, or deduction from, any reserve held for smoothing returns from the investment of member contributions; ’. ˙ Amendment of cl 6.2 (Interest on Accounts) 2. Clause 6.2(b)— omit, insert— ‘ (b) if paragraph (a) does not apply—the voluntary preservation earning rate or, if the Board decides otherwise, the smoothed earning rate. ’.
