s1 2 s5 Superannuation (State Public Sector) Amendment No. 242, 2001 Notice (No. 2) 2001 1 Short title This notice may be cited as the Superannuation (State Public Sector) Amendment Notice (No. 2) 2001 . 2 Notice amended This notice amends the Superannuation (State Public Sector) Notice 2000. 3 Amendment of s 3 (Definitions) Section 3— insert— “retrospective eligibility period” see section 17A(2)’. 4 Insertion of new pt 2A hdg After section 10— insert— ‘PART 2A—ELIGIBLE SCHEMES’. 5 Insertion of new s 10B After section 10A— insert— ‘10B Eligibility of members of eligible scheme established under the Parliamentary Contributory Superannuation Act 1970 (1) A person who is a member of the scheme established under the ParliamentaryContributorySuperannuationAct1970 (the “eligible scheme” ) is eligible for membership of the scheme established under the Act on ceasing to be a member of the eligible scheme. (2) The person’s membership of the scheme is discretionary. (3) The person is eligible for membership in the basic accumulation category.
s6 3 s6 Superannuation (State Public Sector) Amendment No. 242, 2001 Notice (No. 2) 2001 (4) A person who ceased to be a member of the eligible scheme on or after 16 July 2001 and before the commencement of this section is taken to have been eligible for membership of the scheme established under the Act between the time the person ceased his or her membership of the eligible scheme and the commencement of this section. (5) Subsections (2) and (3) apply to a person’s eligibility under subsection (4).’. 6 Replacement of s 17A (Matters relating to retrospective eligibility) Section 17A— omit, insert ‘17A Matters relating to retrospective eligibility (1) This section applies to a person mentioned in column 6 of the schedule who was employed before the declaration day by the unit of the State public sector mentioned opposite in the schedule. (2) The person is taken to have been eligible for membership of the scheme for the period of the person’s employment, before the declaration day, stated in column 6 (the “retrospective eligibility period” ). (3) The person’s eligibility for the retrospective eligibility period is taken to be the eligibility stated in the schedule, on the declaration day, for the equivalent employment. (4) However— (a) despite the schedule, the person’s membership for the retrospective eligibility period is discretionary; and (b) a reference in the schedule to the person’s eligibility for a membership category is taken to be, for a period before the commencement of this notice, eligibility for membership of the corresponding membership category under the Superannuation (State Public Sector) Notice 1996 . (5) Also, the person’s eligibility under this section is subject to any condition stated in column 6. (6) In this section— “condition” includes—
s7 4 s8 Superannuation (State Public Sector) Amendment No. 242, 2001 Notice (No. 2) 2001 (a) a condition that a person was employed by a stated entity at or for a stated time; and (b) a condition that a person’s eligibility is subject to the approval of the person’s employer. “corresponding membership category” means— (a) for the standard defined benefit category—defined benefit member; or (b) for the basic accumulation or comprehensive accumulation category—accumulation member. “declaration day” , for a person, means the day of the commencement of the declaration in this notice— (a) that the person is eligible for membership of the scheme; or (b) that a member of a stated class, of which the person was a member, is eligible for membership of the scheme.’. 7 Omission of ss 17B to 17I Sections 17B to 17I— omit. 8 Replacement of schedule (Eligibility for membership) Schedule— omit, insert—
