This notice may be cited as the Superannuation (State Public Sector) Amendment Notice (No. 1) 1996 . ˙ Commencement 2. This notice commences on 1 May 1996. ˙ Notice amended 3. This notice amends the Superannuation (State Public Sector) Notice 1996 . ˙ Amendment of s 3 (Definitions) 4. Section 3— insert— ‘ “existing QFS officer” means a person who was a QFS officer on 30 April 1996. “QFS officer” means a person appointed to, or employed in, the Queensland Fire Service, and includes the person holding office as commissioner of the Queensland Fire Service. “QFS superannuation scheme” means the fire service superannuation scheme within the meaning of the Fire Service Act 1990 .’. ˙ Amendment of s 5 (Discretionary membership—general) 5. Section 5(4), ‘section 6’— omit, insert— ‘sections 6 and 6A’.

s6 3 s7 Superannuation (State Public Sector) Amendment (No. 1) No. 80, 1996 ˙ Amendment of s 6 (Discretionary membership—QR employees) 6. Section 6(1)(a)— omit. ˙ Insertion of new s 6A 7. After section 6— insert— ˙ ‘ Discretionary membership—QFS officers ‘ 6A.(1) The following existing QFS officers are eligible to become members of the scheme before 1 November 1996— (a) an officer who is entitled to benefits in the defined benefit account of the QFS superannuation scheme; (b) an officer who was entitled to benefits in the defined benefit account of the QFS superannuation scheme that, on the officer turning 60, were transferred to the accumulation account of the QFS superannuation scheme. ‘ (2) An existing QFS officer who started to be employed or engaged in the Queensland Fire Service before 1 April 1964 and has not contributed to the defined benefit account of the QFS superannuation scheme is eligible to become a member of the scheme at any time. ‘ (3) The officer may elect to become a member of the scheme only while the person is eligible for membership. ‘ (4) The election must be made by written notice to the executive director, Government Superannuation Office. ‘ (5) An officer mentioned in subsection (1) becomes a member of the scheme— (a) if the election is made and the officer ceases to be a member of the scheme before 1 July 1996—on the day of the election; or (b) if the election is made on or after 1 July 1996—on 1 July 1996. ‘ (6) An officer mentioned in subsection (2) becomes a member of the scheme on the day of the election.’.

Queensland Fire A person who— Service (a) became a QFS officer on or before 30 April 1996, but at 1 May 1996 is not entitled to be admitted to the defined benefit account of the QFS s upe rannua tion scheme; or (b) becomes a QFS officer on or after 1 May 1996 —’. ˙ Amendment of sch 2 (Discretionary membership) 9.(1) Schedule 2, after item 23— insert — ‘ 23A. 1 Queensland Rail A person who elected or elects to become a member of the scheme under section 6 (2) Schedule 2— insert — ‘ 33. 2 Queensland Fire A person who elects to Service become a member of the scheme under section 6A —’. —’. 1 This item is included merely for information. 2 This item is included merely for information.
