s1 3 s5 Superannuation (State Public Sector) Amendment and No. 53, 2006 Repeal Notice (No. 1) 2006 Part 1 Preliminary 1 Short title This notice may be cited as the Superannuation (State Public Sector) Amendment and Repeal Notice (No. 1) 2006 . 2 Commencement Sections 5 and 12(2), (6) and (8) commence on 1 July 2006. Part 2 Amendment of Superannuation (State Public Sector) Notice 2000 3 Notice amended in pt 2 This part amends the Superannuation (State Public Sector) Notice 2000 . 4 Amendment of s 3 (Definitions) Section 3— insert contract employee means an employee employed under an individual contract of employment.’. 5 Amendment of s 6 (Insurance) (1) Section 6(2)— renumber as section 6(3). (2) Section 6(1)— omit, insert
s6 4 s8 Superannuation (State Public Sector) Amendment and No. 53, 2006 Repeal Notice (No. 1) 2006 ‘(1) This section applies to an employee’s membership in the basic accumulation, comprehensive accumulation or QAS accumulation category. ‘(2) Amounts held for the employee in the scheme must be applied towards prescribed insurance for the employee under the deed, unless the employee elects, under the deed, not to have the insurance.’. 6 Amendment of s 7 (Eligibility generally) Section 7(3), ‘9A’— omit, insert— ‘9B’. 7 Amendment of s 8 (Minimum employment requirements for eligibility) (1) Section 8(a)— omit . (2) Section 8(b) and (c)— renumber as section 8(a) and (b). 8 Insertion of new s 8A After section 8— insert ‘8A Discretionary membership ‘(1) This section applies to a person who is an employee of a unit of the State public sector and for whom membership of the scheme is, under the schedule, discretionary. ‘(2) The person may, at any time while the person is an employee of the unit of the State public sector, decide to become a member of the scheme. ‘(3) If the person decides to become a member of the scheme, the person must, while the person continues to be an employee of
s 9 5 s 10 Superannuation (State Public Sector) Amendment and No. 53, 2006 Repeal Notice (No. 1) 2006 the unit of the State public sector, continue to be a member of the scheme.’. 9 Insertion of new s 9B After section 9A— insert— ‘9B Effect on eligibility of an election under ch 1, pt 6A of deed ‘(1) A member of the scheme who makes an election under chapter 1, part 6A 1 of the deed is eligible for membership in the basic accumulation category only. ‘(2) Subsection (1) applies to the member on the day the election takes effect under chapter 1, part 6A of the deed. ‘(3) This section applies despite part 3. 2 ’. 10 Amendment of s 10 (Spouse or entitled former spouse) (1) Section 10, heading— omit, insert— ‘10 Spouse, entitled former spouse and other persons ’. (2) Section 10(2) to (5)— renumber as section 10(3) to (6).pp (3) Section 10— insert— ‘(2) This section also applies to a person for whom an amount is paid to the fund under any of the following— (a) the Governors (Salary and Pensions) Act 2003 , section 16C; 3 1 Chapter 1 (General), part 6A (Election to stop compulsory contributions) of the deed 2 Part 3 (Closed defined benefit categories) 3 Governors(SalaryandPensions)Act2003 , section 16C (Agreement or court order—minimum benefit)

(2) Section 14(3)— renumber as section 14(4). (3) Section 14— insert ‘(3) Despite subsection (1)(e), a casual employee of the University of Southern Queensland is not excepted from the Act for a period of employment starting on or after 1 July 2005.’. 12 Amendment of schedule (Eligibility for membership) (1) Schedule, notes, note 3— renumber as note 4. (2) Schedule, notes, note 4, as renumbered— omit .
