s1 4 Superannuation (State Public Sector) Amendment (No. 2) The Parliament of Queensland enacts— s3 No. 75, 1999 ˙ Short title 1. This Act may be cited as the Superannuation (State Public Sector) Amendment Act (No. 2) 1999 . ˙ Act amended 2. This Act amends the Superannuation (State Public Sector) Act 1990 . ˙ Insertion of new pt 6 3. After section 32— insert — ‘ PART 6—TRANSITIONAL PROVISION FOR SOUTH EAST QUEENSLAND WATER BOARD (REFORM FACILITATION) ACT 1999 ˙ ‘ SEQWB officers or employees who become SEQWCo employees ‘ 33.(1) This section applies if, on or after the settlement day, a person who is an officer or employee of SEQWB immediately before the settlement day becomes an employee of SEQWCo under the sale of business agreement. ‘ (2) A regulation may, under section 2(1), definition “unit of the State public sector”, paragraph (n), declare SEQWCo to be a unit of the State public sector. ‘ (3) A declaration under subsection (2) operates only for the purpose of this Act and must not be taken to indicate that SEQWCo has a status for the purpose of any other Act. ‘ (4) If SEQWCo is declared to be a unit of the State public sector, the only persons, in relation to SEQWCo, who may be declared eligible for

s3 5 s3 Superannuation (State Public Sector) Amendment (No. 2) No. 75, 1999 membership of the scheme, by a written notice under section 13(1), are transferred employees. ‘ (5) In this section— “sale of business agreement” means the agreement called the Sale of Business Agreement entered into between SEQWB and SEQWCo on 20 September 1999 under the SouthEastQueenslandWaterBoard(Reform Facilitation) Act 1999 , section 5(1). “SEQWB” means the South East Queensland Water Board established under the South East Queensland Water Board Act 1979. “SEQWCo” means South East Queensland Water Corporation Limited ACN 088 729 766. “settlement day” means the settlement day declared under the South EastQueensland Water Board (Reform Facilitation) Act 1999 , section 8 . “transferred employees” means persons who are officers or employees of SEQWB immediately before the settlement day and become employees of SEQWCo under the sale of business agreement.’. © State of Queensland 1999
