Act No. 1, 1993

An Act to amend the Superannuation Act 1916 to provide for the superannuation entitlement of Magistrates who cease to hold office because of invalidity or physical or mental incapacity. [Assented to 18 March 1993]

The Legislature of New South Wales enacts:

Short title

l.

This Act may be cited as the Superannuation (Retired Magistrates)

Amendment Act 1993.

Commencement

2. This Act commences on the date of assent.

Amendment of Superannuation Act 1916 No. 28, sec. 29 (Breakdown pensions)

3. The Superannuation Act 1916 is amended by inserting after section

29 (7) the following subsection:

(8) A contributor who is a Magistrate and who ceases to hold office

(whether before or after the commencement of this subsection) on the Magistrate had been retired by the Magistrate's employer on that ground, if the Board is satisfied as to the Magistrate's invalidity or incapacity in accordance with section 22 (2).
