Superannuation (PSS) Membership Inclusion Declaration No. 9

I, RALPH WILLIS, Minister of State for Finance, make the following Declaration under paragraph 6 (1) (j) of the Superannuation Act 1990.

Citation

1.   This Declaration may be cited as Superannuation (PSS) Membership Inclusion Declaration No. 9.

[NOTE:  This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss. 46A and 48.]

Interpretation

2.   In this Declaration:

“mobility allowance” means an allowance of that name payable in accordance with a determination made under section 82D of the Public Service Act 1922;

“the Act” means the Superannuation Act 1990.

Inclusions

3.   Section 6 of the Act applies to a person who:

(a)   is eligible to be paid a mobility allowance or would be eligible to be paid the allowance except for the amount of income that the person is receiving; and

(b)   was, immediately before first becoming eligible to be paid the allowance:

(i)   a member of the Superannuation Scheme; or

(ii)   an eligible employee for the purposes of the Superannuation Act 1976 who had made an election and declaration under subsection 244 (1) of that Act.
