Superannuation (PSS) Membership Inclusion Declaration No. 10

I, RALPH WILLIS, Minister for Finance, make the following Declaration under paragraph 6 (1) (j) of the Superannuation Act 1990.

Citation

1.   This Declaration may be cited as Superannuation (PSS) Membership Inclusion Declaration No. 10.

Interpretation

2.   In this Declaration:

“Act” means the Superannuation Act 1990;

“Corporation” means the Fisheries Research and Development Corporation.

Inclusion of certain persons as members of the Superannuation Scheme

3.   (1)    For the purposes of paragraph 6 (1) (j) of the Act, a person who:

(a)   either:

(i)   was an employee, or a director, of the Corporation on 1 September 1992; or

(ii)   became an employee, or a director, of the Corporation before the commencement of this Declaration; and

(b)   has not ceased to be either an employee or a director of the Corporation; and

(c) has elected, other than under section 8 of the Act, to become a member of the Superannuation Scheme before the day on which this Declaration is notified in the Gazette;

is declared to be a person to whom section 6 of the Act applies.

(2)   Subclause (1) has effect in relation to a person on and from:

(a)   1 September 1992; or

(b)   the day on which the person became an employee, or a director, of the Corporation;

whichever is the later.
