Superannuation (PSS) Membership Inclusion Declaration No. 1

I, RALPH WILLIS, Minister of State for Finance, make the following Declaration under paragraph 6 (1) (j) of the Superannuation Act 1990.

Citation
                1.  This Declaration may be cited as Superannuation (PSS) Membership Inclusion Declaration No. 1.

Interpretation
                2.  In this Declaration, unless the contrary intention appears:

“eligible employee” has the meaning given by the 1976 Act;

“1976 Act” means the Superannuation Act 1976;
“the Act” means the Superannuation Act 1990.
Inclusions
                3.  Section 6 of the Act applies to a class of persons each of whom:


               (a)  is a director or an employee of the Dairy Research and Development Corporation; and

               (b)  either:

   (i)  was a member of the Superannuation Scheme (other than a person to whom Part IV of the Public Service Act 1922 applied) immediately before becoming a person specified in paragraph (a); or

   (ii)  has made an election and declaration under subsection 244 (1) of the 1976 Act; and

               (c)  has not at any time since becoming a person specified in paragraph (a) ceased to be such a person; and

               (d)  since becoming a person specified in paragraph (a) has not been a member of another superannuation scheme applying in relation to that person's employment with the Dairy Research and Development Corporation, other than the Superannuation Scheme; and

               (e)  is not a person to whom Part IV of the Public Service Act 1922 applies.
