Superannuation (PSS) Membership Inclusion Declaration2 (Amendment)

I, KIM CHRISTIAN BEAZLEY, Minister for Finance, make the following Declaration under paragraph 6 (1) (j) of the Superannuation Act 1990.

1.   Commencement

1.1   This Declaration commences on 1 July 1995.

2.   Amendment

2.1   The Superannuation (PSS) Membership Inclusion Declaration  is amended as set out in this Declaration.

3.   Clause 2 (Interpretation)

3.1   Subclause 2 (1) (definition of “alternative superannuation scheme”):

Omit the definition, substitute:

‘alternative superannuation scheme’, in relation to particular employment of a person with an employer, means a superannuation scheme (other than the Public Sector Superannuation Scheme), that is not:

             (a)   a scheme to the extent that membership of that scheme by the person is for the preservation, or payment, of productivity benefits; or

             (b)   the scheme provided for by the 1976 Act to the extent that membership of that scheme by the person relates to other employment (if any) with the employer; or

             (c)   in the case of a prescribed person—a scheme, or part of a scheme, of which the person is taken to be a member for top-up purposes; or

             (d)   a scheme to the extent that participation in that scheme on the person’s behalf by the person’s employer is for purposes solely related to satisfying the employer’s obligations under the Superannuation Guarantee  (Administration)  Act 1992;”. 

3.2   Subclause 2 (1):

After the definition of “prescribed person”, insert:

‘productivity benefits’ means benefits that are productivity related benefits within the meaning of section 110A of the 1976 Act;”. 

3.3   Paragraph 2 (2) (b):

Omit the paragraph, substitute:

            “(b)   a top-up arrangement and any of the following circumstances:

   (i)   contributions relating to performance pay are made to the scheme;

   (ii)   the person is a member of the scheme for the purpose of the preservation, or payment, of productivity benefits;

   (iii)   participation in the scheme on the person’s behalf by the person’s employer is for purposes solely related to satisfying the employer’s obligations under the Superannuation Guarantee  (Administration)  Act 1992.”.

4.   Schedule (Persons to whom section 6 of the 1990 Act applies)

4.1   Paragraphs 1 (c) and 2 (c), subparagraphs 3 (b) (i), 4 (b) (i), 5 (a) (i) and 6 (c) (i), paragraph 6 (d), subparagraph 7 (e) (i), paragraph 7 (f), sub-subparagraph 8 (b) (ii) (A), paragraph 8 (d) and subparagraph 9 (b) (i):

Omit “Superannuation Scheme”, substitute “Public Sector Superannuation Scheme”.
