| Statutory Rules 1997 No. 2121 __________________ Superannuation (PSS) Membership Inclusion Declaration2 (Amendment) I, JOHN JOSEPH FAHEY, Minister for Finance, make the Dated 11 August 1997. JOHN FAHEY ____________ 1. Commencement 1.1 This Declaration is taken to have commenced on 30 June 1992. 2. Amendment 2.1 The Superannuation (PSS) Membership Inclusion Declaration is amended as set out in this Declaration. 3. Clause 3 (Persons to whom section 6 of the 1990 Act applies) 3.1 Subclause 3 (1): Omit “and (4),”, substitute “, (4) and (5),”. 3.2 Add at the end: “(5) Section 6 of the 1990 Act ceases to apply to a person referred to in item 12 in the Schedule at the end of the first occurring of the following days: (a) 31 December 1996; or (b) the day on which the person ceases to be employed by the Nuclear Safety Bureau (‘NSB’); or (c) the day immediately before the day on which the person becomes a member of an alternative superannuation scheme in relation to the person’s employment with NSB; or (d) the day immediately before the day on which the person becomes a person to whom Division 2 or 3 of Part IV of the Public Service Act 1922 applies.”. 4. Schedule (Persons to whom section 6 of the 1990 Act applies) 4.1 Add at the end: “12 A person who: (a) is an employee of the Nuclear Safety Bureau (‘NSB’); and (b) after becoming an employee of NSB, made contributions to the Public Sector Superannuation Scheme as if he or she were a member of that Scheme, despite the fact that he or she was not entitled to make contributions to that Scheme; and (c) in relation to the person’s employment with NSB, is not a member of an alternative superannuation scheme; and (d) is not a person to whom Division 2 or 3 of Part IV of the Public Service Act 1922 applies.”.
