| Superannuation (PSS) Membership Inclusion Amendment Declaration 1999 (No. 1) Statutory Rules 1999 No. 169 I, JOHN JOSEPH FAHEY, Minister for Finance and Administration, make the following Declaration under paragraph 6 (1) (j) of the Superannuation Act 1990. Dated 23 August 1999.

Schedule 1 Amendments (section 3) [1] Subclause 3 (1) omit (8) and (9), substitute (8), (9) and (10), [2] After subclause 3 (9) insert (10) Section 6 of the 1990 Act ceases to apply to a person referred to in item 18 in the Schedule at the end of the earliest of the following days: (a) the day on which the person ceases to be an employee of the Australian Government Solicitor; (b) the day immediately before the day on which the person becomes a member of a superannuation scheme that applies to that person’s employment by the Australian Government Solicitor, other than: (i) the scheme provided for in the 1990 Act; or (ii) a scheme to which contributions are made in respect of the person only in relation to performance pay; or (iii) a scheme of which the person is a member for top-up purposes only; (c) the day immediately before the day on which the Australian Government Solicitor ceases to be a Commonwealth authority within the meaning of the Commonwealth Authorities and Companies Act 1997. [3] Schedule, after item 17 insert 18 A person who: (a) on or after 1 September 1999 becomes an employee of the Australian Government Solicitor; and (b) is a person who immediately before last becoming so employed, was a member of the Public Sector Superannuation Scheme; and (c) is not in relation to the person’s employment with the Australian Government Solicitor, a member of a superannuation scheme, other than: (i) the scheme provided for by the 1990 Act; or (ii) a scheme to which contributions are made in respect of the person only in relation to performance pay; or (iii) a scheme of which the person is a member for top-up purposes only.
