Superannuation (PSS) Membership Exclusion Declaration No. 5

I, RALPH WILLIS, Minister of State for Finance, make the following Declaration under paragraph 6 (2) (c) of the Superannuation Act 1990.

1.   Citation

1.1 This Declaration may be cited as Superannuation (PSS) Membership Exclusion Declaration No. 5.

[NOTE:  This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss. 46A and 48.]

2.   Amendment

2.1   Superannuation (PSS) Membership Exclusion Declaration No. 4 ² is amended as set out in this Declaration.

3.   Clause 3 (Interpretation)

3.1   After the definition of “eligible employee”, insert:

“ ‘mobility allowance’ means an allowance of that name payable in accordance with a determination made under section 82D of the Public Service Act;”.

4.   Schedule

4.1   Item 1:

Add at the end:

“; and  (c)   who is not eligible to be paid a mobility allowance for a reason other than the amount of income that the person is receiving.”.

4.2   Item 2:

Add at the end:

“; and  (d)   who is not eligible to be paid a mobility allowance for a reason other than the amount of income that the person is receiving.”.

4.3   Item 7:

Add at the end:

“; and  (e)   who is not eligible to be paid a mobility allowance for a reason other than the amount of income that the person is receiving.”.

4.4   Item 21:

After “A person”, insert “who is not eligible to be paid a mobility allowance for a reason other than the amount of income that the person is receiving and”.

4.5   Item 22:

After “A person”, insert “who is not eligible to be paid a mobility allowance for a reason other than the amount of income that the person is receiving and”.

4.6   Item 27:

After “A person”, insert “who is not eligible to be paid a mobility allowance for a reason other than the amount of income that the person is receiving and”.

4.7   Item 29:

After “A person”, insert “who is not eligible to be paid a mobility allowance for a reason other than the amount of income that the person is receiving and”.
