1. Amendment
1.1 The Superannuation (PSS) Membership Exclusion Declaration is amended as set out in this Declaration.
2. Schedule (Persons to whom section 6 of the 1990 Act does not apply)
2.1 Add at the end:

I, KIM CHRISTIAN BEAZLEY, Minister for Finance, make the following Declaration under paragraph 6 (2) (c) of the Superannuation Act 1990.

1.   Amendment

1.1   The Superannuation (PSS) Membership Exclusion Declaration is amended as set out in this Declaration.

[NOTE: This Declaration commences on gazettal: see Acts Interpretation Act 1901, ss. 46A and 48.]


2.   Schedule (Persons to whom section 6 of the 1990 Act does not apply)

2.1   Add at the end:

“36

A person (in this item referred to as ‘a contributions-barred person’) in respect of whom, under the Superannuation Industry (Supervision) Act 1993, contributions to a regulated superannuation fund cannot be accepted, other than:

             (a)   a person who:

   (i)   immediately before the commencement of this item, was a PSS member; and

   (ii)   has since remained a PSS member; or

             (b)   a person (not being a person referred to in paragraph (a)) who:

   (i)   immediately before becoming a contributions-barred person, was a PSS member; and

   (ii)   has since remained a PSS member.”.
