SUPERANNUATION LEGISLATION FURTHER AMENDMENT

(L.S.) GORDON SAMUELS, Governor.

I, the Honourable Gordon Samuels AC, Governor of the State of New South Wales, with the advice of the Executive Council, and in pursuance of section 2 of the Superannuation Legislation Further Amendment Act 1998, do, by this my Proclamation:

appoint 1 February 1999 as the day on which the following provisions
of that Act commence:
Schedule 1
Schedule 2.3 [ l ]
Schedule 2.4 [ l ]
Schedule 2.5 [1], [4] and [37]
the long title and any provision not commenced either directly by
section 2 of the Act or by a subsequent paragraph of this Proclamation
appoint 1 March 1999 as the day on which the following provisions of
that Act commence:
Schedule 2.1 [1]–[4], [6]–[17], [19], [21]–[24] and [26]–[28]
Schedule 2.5 [16], [17], [19], [20] and [33]–[36]
Schedule 2.5 [38], in so far as it inserts the heading to Part 7 and
clauses 17, 19 and 20 into Schedule 25 of the Superannuation Act
1916
Schedule 2.6 [ l ] and [3]
appoint 1 April 1999 as the day on which the following provisions of
that Act commence:
Schedule 2.5 [2], [3] and [5]–[15]

that Act commence:
Schedule 2.1 [5], [18], [20] and [25]
Schedule 2.5 [18] and [21]–[26]
Schedule 2.5 [38], in so far as it inserts clauses 21 and 22 into
Schedule 25 of the Superannuation Act 1916

Schedule 2.5 [38], in so far as it inserts clause 18 into Schedule 25 of
the Superannuation Act 1916

appoint 1 July 1999 as the day on which the following provisions of

EXPLANATORY NOTE

This Proclamation commences certain provisions of the Superannuation Legislation

Further Amendment Act 1998. The provisions concerned (with their commencement

dates) may be described as follows:

(a) on 1 February 1999:

(i)

amendments relating to the right of transfer from the State Superannuation Scheme and the Police Superannuation Scheme to the First State Superannuation Scheme,

(ii)

amendments consequential on the commencement (on assent to the Act) of Schedule 2.6 [2], [4] and [6] (relating to mobility of members of the Local Government Superannuation Scheme),

(iii)

amendments relating to unallocated amounts in the reserves of the State superannuation Fund,

(iv)

the long title and any other provision of the Act not otherwise commenced.

(b) on 1 March 1999-amendments:

(i)

providing for the administration of the First State Superannuation Scheme in accordance with a trust deed,

(ii)

relating to earlier commutation of pension in the State Superannuation Scheme,

(iii)

relating to the calculation of shift allowance loading as a component of salary for the purposes of the State Superannuation Scheme,

(c)

on 1 April 1999-amendments relating to part-time leave without pay granted to contributors to the State Superannuation Scheme,

(d) on 1 July 1999-amendments:
(i) relating to the minimum benefit payable to a contributor to the State Superannuation Scheme and to the deferral of retrenchment benefits under that scheme in certain cases,
(ii) consequential on the commencement (by virtue of section 2 (3) of the Act) of Schedule 2.2 (relating to standards for the preservation and release of superannuation benefits).
