I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Industry (Supervision) Act 1993.

  1. Name of Regulations

These Regulations are the Superannuation Industry (Supervision) Amendment Regulations 2009 (No. 5).

  1. Commencement

These Regulations commence on the day after they are registered.

  1. Amendment of Superannuation Industry (Supervision) Regulations 1994

Schedule 1 amends the Superannuation Industry (Supervision) Regulations 1994.

Schedule 1          Amendments

(regulation 3)

[1]          Subparagraph 9.05 (a) (iii)

omit

Benefits Scheme; and

insert

Benefits Scheme;

[2]          After subparagraph 9.05 (a) (iii)

insert

(iv)the scheme established under the Superannuation (State Public Sector) Act 1990 (Qld); and

[3]          After subregulation 13.13 (3)

insert

(4)This regulation does not apply to a charge imposed under the Public Officers Superannuation Benefits Recovery Act 1988 (Qld) in relation to a member’s benefits in the scheme established under the Superannuation (State Public Sector) Act 1990 (Qld).
