I, QUENTIN BRYCE, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following regulation under the Superannuation Industry (Supervision) Act 1993.

Name of regulation
This regulation is the Superannuation Industry (Supervision) Amendment Regulation 2012 (No. 4).

Commencement
This regulation commences on the day after it is registered.

Amendment of Superannuation Industry (Supervision) Regulations 1994
Schedule 1 amends the Superannuation Industry (Supervision) Regulations 1994.
Schedule 1 Amendment
(section 3)
[1] Paragraph 1.03A (1) (a)
substitute
(a)the member is uncontactable, that is, if and only if:
(i)either:
(A)the fund has never had an address for the member; or
(B)2 written communications have been sent, or, if the trustee so chooses, one written communication has been sent, by the fund to the member’s last known address and returned unclaimed; and
(ii)the fund has not received a contribution or rollover in respect of the member within the last 12 months of the member’s membership of the fund; or
