I, PHILIP MICHAEL JEFFERY, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Guarantee (Administration) Act 1992.

1Name of Regulations

These Regulations are the Superannuation Guarantee (Administration) Amendment Regulations 2005 (No. 2).

2Commencement

These Regulations commence as follows:

  1. (a)

    on 1 July 2005 — regulations 1 to 3 and Schedule 1;

  2. (b)

    on 1 July 2006 — Schedule 2.

3Amendment of Superannuation Guarantee (Administration) Regulations 1993

  1. (1)

    Schedule 1 amends the Superannuation Guarantee (Administration) Regulations 1993, as amended by the Superannuation Guarantee (Administration) Amendment Regulations 2005 (No. 1).

Note The Superannuation Guarantee (Administration) Amendment Regulations 2005 (No. 1) are Select Legislative Instrument 2005 No. 25.

  1. (2)

    Schedule 2 amends the Superannuation Guarantee (Administration) Regulations 1993.

Schedule 1Amendments commencing on 1 July 2005

(regulation 3)

[1]Paragraph 9A (2) (g)

  1. (g)

    if, in respect of an employee, the employer makes contributions:

    1. (i)

      to a fund or successor fund governed by rules that, on 11 March 2005, determined that an amount of not less than $50 000 will be payable in respect of the death of an employee; and

    2. (ii)

      that were continuing on, or commenced after, 11 March 2005.
