I, PETER JOHN HOLLINGWORTH, Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Guarantee (Administration) Act 1992.

1Name of Regulations

 These Regulations are the Superannuation Guarantee (Administration) Amendment Regulations 2001 (No. 3).

2Commencement

 These Regulations commence on 1 January 2002.

3Amendment of Superannuation Guarantee (Administration) Regulations 1993

Schedule 1 amends the Superannuation Guarantee (Administration) Regulations 1993.

[1]Regulation 2, after definition of responsible officers

insert

scheduled international social security agreement has the meaning given by subsection 5 (1) of the Social Security (International Agreements) Act 1999.

[2]After regulation 7AB

insert

7ACExclusion of salary or wages under scheduled international social security agreement (Act s 27 (1) (e))

 For paragraph 27 (1) (e) of the Act, payments of salary or wages are prescribed if a scheduled international social security agreement provides that the employer to which the salary or wages relate is not subject to the Act in relation to the work for which the salary or wages were paid.
