This order in council may be cited as the Superannuation (Government and Other Employees—Articles) Order 1991 . Approval of amendments of Articles of the Government Officers’ Superannuation Scheme 2. The amendments of The Articles of the Government Officers’ Superannuation Scheme set out in this order are approved.
2 Superannuation (Government and Other Employees—Articles) Order 1991 Amendment of Article 5 (EMPLOYER CONTRIBUTIONS) 3. Article 5— omit all the words after Article 5(2), insert — ‘Discretionary contributions ‘(3) The Board may, in its absolute discretion, receive from any Employer, for and on behalf of any Employee of the Employer who has not attained the age of 65 years, amounts in addition to those referred to in Articles 5(1) and (2). ‘Method of payment ‘(4) All payments to be made to the Board by an Employer under the terms of these Articles must be made by such method as the Board from time to time directs. ’. Amendment of Article 9 (PRESERVATION AND OUTWARD PORTABILITY) 4. Article 9(2)— omit all the words before the Table, insert — ‘(2) Despite Article 9(1), if a Member elects, under section 3B of the State Service Superannuation Act 1972 , to become a member of the scheme within the meaning of the Superannuation (State Public Sector) Act 1990 , then— (a) so much of the amount standing to the credit of the Member’s Account as represents the Member’s Accumulated Employer Contributions is to be transferred to the Government Superannuation Provision Fund kept by the Treasurer; and (b) the remainder of the amount (if any) standing to the credit of the Member’s Account is to be transferred to the State Public Sector Superannuation Fund. ‘(3) Despite Article 9(1), if— (a) a Member who becomes an employee of Griffith University elects under section 8(2) of the Griffith University and
3 Superannuation (Government and Other Employees—Articles) Order 1991 Queensland Conservatorium of Music Amalgamation and Miscellaneous Amendments Act 1991 to become a member of the Superannuation Scheme for Australian Universities; or (b) a Member who is employed by one of the educational institutions specified in the following Table elects, under section 3B of the State Service Superannuation Act 1972 , to become a member of the Superannuation Scheme for Australian Universities; then the amount standing to the credit of the Member’s Account is to be transferred to the Trustee of the Tertiary Education Superannuation Scheme. ’.
