s1 3 s2 Superannuation (Government and Other Employees) Amendment of Articles (No. 1) No. 224, 1994 ˙ Short title 1. This regulation may be cited as the Superannuation (Government and Other Employees) Amendment of Articles Regulation (No. 1) 1994 . ˙ Approval of amendments of Articles of the Government Officers’ Superannuation Scheme 2. The amendments of The Articles of the Government Officers’ Superannuation Scheme set out in Schedules 1 and 2 are approved. 1 1 The Articles were initially published in the Gazette dated 30 June 1988 at pages 2503–11.

Article 1— omit, insert— Article 1—Articles of governing scheme ˙ Title 1. This document is The Articles of the Government Officers’ Superannuation Scheme.’. ˙ Omission of Article 2 (Parts of the Articles) 2. Article 2— omit. ˙ Amendment of Article 3 (Interpretation) 3.(1) Article 3, heading— omit, insert— Article 2—Interpretation ’. (2) Article 3(1), definition “Act” , “Board” , “Employee” , “Fund” , “Medical Practitioner” omit, insert—

(4) Article 3(2) to (7)— omit. No. 224, 1994 ˙ Insertion of new s 3 4. After section 2 (in Article 2) insert— ˙ Definition of “employee” 3.(1) “Employee” means a person who is employed by or under the State on a regular basis. (2) Without limiting subsection (1), “employee” includes— (a) a person who— (i) is an officer under the StateServiceSuperannuationAct1972 ; and (ii) is employed on a regular basis; and (b) a police officer or police recruit under the PoliceServiceAdministration Act 1990 ; and (c) a person approved by regulation made for the purposes of paragraph (db) of the definition “officer” in section 4 of the StateService Superannuation Act 1972 ; and (d) a person approved by regulation to be a member of the scheme. (3) However, “employee” does not include— (a) a person who is a Supreme or District Court judge; or (b) a person who is— (i) Commissioner under the Industrial Relations Act 1990 ; or (ii) a member of the Land Court; or
6 Superannuation (Government and Other Employees) Amendment of Articles (No. 1) SCHEDULE 1 (continued) No. 224, 1994 (iii) employed under the Electricity Act 1976 ; unless the person is a contributor to the State Service Superannuation Fund; or (c) a person who— (i) is an employee of, or engaged by, a unit of the State public sector while on leave from other employment; and (ii) is a member of another superannuation scheme operated for the other employment and the State contributes, by agreement, to the other scheme as the person’s employer; or (d) a person who— (i) before 1 July 1991— (A) was employed by a university established under an Act; and (B) has the status equivalent to, or higher than, a lecturer; and (C) is eligible to contribute to a superannuation scheme for members of staff of the university; and (D) is not a contributor to the State Service Superannuation Fund; or (ii) on or after 1 July 1991— (A) began employment with, or was engaged by, a university established under an Act or the University College of Central or Southern Queensland; and (B) is not a contributor to the State Service Superannuation Fund; or (e) an officer of the Legal Aid Commission who is a contributor to the Commonwealth Superannuation Scheme established under the Superannuation Act 1976 (Cwlth); or (f) a person excluded by regulation from membership of the scheme.’.

After Article 2, in Part 1— insert— Article 3—Articles to comply with prescribed standards ˙ Prescribed standards 4.(1) The standards prescribed under section 7(1) of the Occupational Superannuation Standards Act 1987 (Cwlth) are taken to be included in these Articles. (2) If a standard is inconsistent with a provision of these Articles, the standard prevails to the extent of the inconsistency.’. ˙ Amendment of Article 4 (Eligibility of Employees) 6.(1) Article 4, heading— omit, insert— Article 4—Eligibility of employees ’. (2) Article 4(1)— renumber as section 5. (3) Article 4(2)— renumber as section 6. ˙ Amendment of Article 5 (Employer Contributions) 7.(1) Article 5, heading— omit, insert— Article 5—Employer contributions ’. (2) Article 5, before Article 5(1)— insert new section 7—

In this Article— “base year” means— (a) for an employer who was an employer for the whole of the financial year starting on 1 July 1991—that financial year; or (b) for an employer who was not an employer for the whole of the financial year starting on 1 July 1991—the first financial year in which the employer is an employer for the whole of the year. “prescribed percentage” means— (a) for a member who is a contributor under the PoliceSuperannuation Act 1974, the State Service Superannuation Act1972 or another scheme the Minister decides is a scheme to which this Article applies—3%; or (b) for a member who is employed by an employer the Minister decides is an employer to which this Article applies and whose annual payroll for the base year is not more than $1 000 000—4%; or (c) for another member—5%.’.
