Part 1—Introductory
1 Name of Regulations
These Regulations are the Superannuation (Financial Assistance Funding) Levy and Collection Regulations 2005.
2 Commencement
These Regulations commence on the day after they are registered.
3 Definitions
In these Regulations:
APRA means the Australian Prudential Regulation Authority.
Collection Act means the Financial Institutions Supervisory Levies Collection Act 1998.
Levy Act means the Superannuation (Financial Assistance Funding) Levy Act 1993.
levy‑exempt fund means:
(a) in relation to the Superannuation (Financial Assistance Funding) Levy No. 2001–2002: 2—a fund mentioned in Schedule 1; and
(b) in relation to the Superannuation (Financial Assistance Funding) Levy No. 2002–2003: 1—a fund mentioned in Schedule 2; and
(c) in relation to the Superannuation (Financial Assistance Funding) Levy No. 2003–2004: 1—a fund mentioned in Schedule 3; and
(d) in relation to the Superannuation (Financial Assistance Funding) Levy No. 2004–2005:1—a fund mentioned in Schedule 4.

4 Imposition of levy
(1) For subsection 6(1A) of the Levy Act, a levy is imposed on each fund that is not a levy‑exempt fund.
(2) For subsection 6(2) of the Levy Act, the number of the levy is Superannuation (Financial Assistance Funding) Levy No. 2001–2002: 2.
5 Rate of levy
For the definition of applicable rate in subsection 8(1) of the Levy Act, the rate of the levy applicable to a fund is 0.000022.
Note: Under subsection 8(1) of the Levy Act, the amount of levy imposed on a fund is worked out by multiplying the applicable rate by the value of the fund’s assets.
6 Maximum and minimum amounts of levy
(1) For paragraph 6(3)(a) of the Levy Act, the maximum amount of levy is $20 000.
(2) For paragraph 6(3)(b) of the Levy Act, the minimum amount of levy is $10.
Note: For the effect of the maximum and minimum rates of levy, see subsection 8(1A) of the Levy Act.
7 When levy due for payment
For section 19 of the Collection Act, levy payable by the trustee of a fund is due and payable:
(a) on 14 June 2005; or
(b) in the case of a fund for which APRA approves a later date (being a date not later than 30 days after the date specified in paragraph (a))—on the later date.

8 Imposition of levy
(1) For subsection 6(1A) of the Levy Act, a levy is imposed on each fund that is not a levy‑exempt fund.
(2) For subsection 6(2) of the Levy Act, the number of the levy is Superannuation (Financial Assistance Funding) Levy No. 2002–2003: 1.
9 Rate of levy
For the definition of applicable rate in subsection 8(1) of the Levy Act, the rate of the levy applicable to a fund is 0.000252.
Note: Under subsection 8 (1) of the Levy Act, the amount of levy imposed on a fund is worked out by multiplying the applicable rate by the value of the fund’s assets.
10 Maximum and minimum amounts of levy
(1) For paragraph 6(3)(a) of the Levy Act, the maximum amount of levy is $85 000.
(2) For paragraph 6(3)(b) of the Levy Act, the minimum amount of levy is $100.
Note: For the effect of the maximum and minimum rates of levy, see subsection 8(1A) of the Levy Act.
11 When levy due for payment
For section 19 of the Collection Act, levy payable by the trustee of a fund is due and payable:
(a) on 14 June 2005; or
(b) in the case of a fund for which APRA approves a later date (being a date not later than 30 days after the date specified in paragraph (a))—on the later date.

12 Imposition of levy
(1) For subsection 6(1A) of the Levy Act, a levy is imposed on each fund that is not a levy‑exempt fund.
(2) For subsection 6(2) of the Levy Act, the number of the levy is Superannuation (Financial Assistance Funding) Levy No. 2003–2004: 1.
13 Rate of levy
For the definition of applicable rate in subsection 8(1) of the Levy Act, the rate of the levy applicable to a fund is 0.000046.
Note: Under subsection 8 (1) of the Levy Act, the amount of levy imposed on a fund is worked out by multiplying the applicable rate by the value of the fund’s assets.
14 Maximum and minimum amounts of levy
(1) For paragraph 6(3)(a) of the Levy Act, the maximum amount of levy is $30 000.
(2) For paragraph 6(3)(b) of the Levy Act, the minimum amount of levy is $100.

15 When levy due for payment
For section 19 of the Collection Act, levy payable by the trustee of a fund is due and payable:
(a) on 14 June 2005; or
(b) in the case of a fund for which APRA approves a later date (being a date not later than 30 days after the date specified in paragraph (a))—on the later date.

16 Imposition of levy
(1) For subsection 6(1A) of the Levy Act, a levy is imposed on each fund that is not a levy‑exempt fund.
(2) For subsection 6(2) of the Levy Act, the number of the levy is Superannuation (Financial Assistance Funding) Levy No. 2004–2005:1.
17 Rate of levy
For the definition of Applicable rate in subsection 8(1) of the Levy Act, the rate of the levy applicable to a fund is 0.0000085.
Note: Under subsection 8(1) of the Levy Act, the amount of levy imposed on a fund is worked out by multiplying the applicable rate by the value of the fund’s assets.
18 Maximum and minimum amounts of levy
(1) For paragraph 6(3)(a) of the Levy Act, the maximum amount of levy is $35 000.
(2) For paragraph 6(3)(b) of the Levy Act, the minimum amount of levy is $120.
Note: For the effect of the maximum and minimum rates of levy, see subsection 8(1A) of the Levy Act.
19 When levy due for payment
For section 19 of the Collection Act, levy payable by the trustee of a fund is due and payable:
(a) 28 days after the commencement of this regulation; or
(b) in the case of a fund for which APRA approves a later date (being a date not later than 58 days after commencement of this regulation)—on the later date.

20 Imposition of levy
(1) For subsection 6(1A) of the Levy Act, a levy is imposed on each fund that is not a levy‑exempt fund.
(2) For subsection 6(2) of the Levy Act, the number of the levy is Superannuation (Financial Assistance Funding) Levy No. 2010–2011: 1.
21 Rate of levy
For the definition of applicable rate in subsection 8(1) of the Levy Act, the rate of the levy applicable to a fund is 0.0001347.
Note: Under subsection 8(1) of the Levy Act, the amount of levy imposed on a fund is worked out by multiplying the applicable rate by the value of the fund’s assets.
22 Maximum and minimum amounts of levy
(1) For paragraph 6(3)(a) of the Levy Act, the maximum amount of levy is $750 000.
(2) For paragraph 6(3)(b) of the Levy Act, the minimum amount of levy is $50.

23 When levy due for payment
For section 19 of the Collection Act, levy payable by the trustee of a fund is due and payable:
(a) 28 days after the commencement of this regulation; or
(b) if APRA determines a later day—on that later day.

24 Imposition of levy
(1) For subsection 6(1A) of the Levy Act, a levy is imposed on each fund that is not a levy‑exempt fund.
(2) For subsection 6(2) of the Levy Act, the number of the levy is Superannuation (Financial Assistance Funding) Levy No. 2012‑2013: 1.
25 Rate of levy
For the definition of applicable rate in subsection 8(1) of the Levy Act, the rate of the levy applicable to a fund is 0.00002497.
26 Maximum and minimum amounts of levy
(1) For paragraph 6(3)(a) of the Levy Act, the maximum amount of levy is $750,000.
(2) For paragraph 6(3)(b) of the Levy Act, the minimum amount of levy is $50.
27 When levy due for payment
For section 19 of the Collection Act, the levy payable by the trustee of a fund is due and payable:
(a) 28 days after the commencement of this regulation; or
(b) if APRA determines a later day—on that later day.
