Superannuation (Eligible Employees) Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Superannuation Act 1976.

Commencement

1. These Regulations shall come into operation on 1 July 1984.

Principal Regulations

2. In these Regulations, “Principal Regulations” means the Superannuation (Eligible Employees) Regulations.

Interpretation

3. Regulation 3 of the Principal Regulations is amended by omitting the definition of “superannuation scheme” and substituting the following definition:

“‘superannuation scheme’ means a scheme, fund or arrangement, however established, under which superannuation or retirement benefits are payable, but does not include the following schemes:

(a) the scheme constituted by the provisions of the Act;

(b) the Northern Territory Police Supplementary Benefit Scheme, being the scheme of that name to which members of the Police Force of the Northern Territory are, under the terms and conditions of service applicable to them, required to contribute;”.

Certain employees not to be eligible employees

4. Regulation 4 of the Principal Regulations is amended

(a) by omitting from sub-paragraph (a) (ii) “(not being the scheme constituted by the provisions of the Act)”;

(b) by omitting from sub-paragraph (aa) (ii) “(not being the scheme constituted by the provisions of the Act)”; and

(c) by omitting from sub-paragraph (o) (ii) “(not being the scheme constituted by the provisions of the Act)”.
