Superannuation (Eligible Employees) Regulations (Amendment) (Cth)
I,
THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice
of the Federal Executive Council, hereby make the following Regulation under
the
Dated 16 May 1990.

Regulation 4 of the Superannuation (Eligible Employees) Regulations is amended by adding at the end the following paragraph:
“(zj) persons (including persons specified in a direction given under section 11, 12 or 13 of the Act) who are directors or employees of Australian Defence Industries Pty. Ltd. other than:
(i) a person:
(a) who became a director or employee of Australian Defence Industries Pty. Ltd. before the commencement of this paragraph and who has at all times after becoming such director or employee, been a director or employee of Australian Defence Industries Pty. Ltd.; and
(b) who was an eligible employee immediately before becoming a director or employee of Australian Defence Industries Pty. Ltd.; and
(c) who, if he or she did not become employed by Australian Defence Industries Pty. Ltd. by operation of a declaration under section 81c of the
Public Service Act 1922 , section 42d of theNaval Defence Act 1910 or section 10a of the
(S.R. 122/90)—Cat. No 14/2.5.1990
Supply and Development Act 1939 ,did not request in writing before the commencement of this paragraph not to be treated as an eligible employee; and(ii) a person who is a director or employee of Australian Defence Industries Pty. Ltd. during a period while on leave without pay from employment by the Commonwealth or an approved authority other than Australian Defence Industries Pty. Ltd.; and
(iii) a person who was an invalidity pensioner immediately before becoming a director or employee of Australian Defence Industries Pty. Ltd.; and
(iv) a person to whom Division 2 or 3 of Part IV of the Public Service Act applies.”.
