Regulations2 (Amendment)

I, THE GOVERNOR-GENERAL of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, hereby make the following Regulations under the Superannuation Act 1976.

Commencement

1. These Regulations commence on 1 July 1990.

Interpretation

2. Regulation 3 of the Superannuation (Eligible Employees) Regulations is amended:

(a) by omitting “the following schemes” from the definition of “superannuation scheme”;

(b) by adding “or” at the end of paragraph (a) of the definition of “superannuation scheme”;

(c) by adding at the end of the definition of “superannuation scheme” the following word and paragraph:

“; or

(c) a scheme, or a part of a scheme, that is established for the preservation, or payment of, benefits of the kind referred to as ‘interim benefits’ in the Superannuation (Productivity Benefit) Act 1988;”.

Persons not included in the definition of “eligible employee”

3. Regulation 4 of the Superannuation (Eligible Employees) Regulations is amended:

(a) by adding at the end of paragraph (aa) the following word and subparagraph:

“; and

(iii) are not persons to whom section 51 of the Act applies;”;

(b) by adding at the end of subparagraph (o) (i) “and”;

(c) by inserting after subparagraph (o) (ii) the following subparagraph:

“(iia) who are not persons to whom section 51 of the Act applies; and”.
