Superannuation (Deferred Benefits) Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Act 1976.

1.   Amendment

1.1   The Superannuation (Deferred Benefits) Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2.   Schedule (Modifications of the Act in its application to persons to whom subsection 136 (4) of the Act applies)

2.1   Modifications to section 112 (first modification):

Omit the modification, substitute:

“112 Omit from subsection (6) ‘Subject to subsection (7)’,  substitute ‘Subject to subsections (7), (9A), (9B) and  (9C)’”.

2.2   Modifications to section 112 (second modification):

Renumber the substituted subsections (10), (10AA), (10AB) and (10AC) as subsections (9A), (9B), (9C) and (9D) respectively.

2.3   Modifications to section 112 (second modification):

Substituted subsection 112 (9B):

Omit “subsection (10AB)”, substitute “subsection (9C)”.

2.4   Modifications to section 112 (second modification):

Substituted subsection 112 (9B):

Omit “subsection (10AC)”, substitute “subsection (9D)”.

2.5   Modifications to section 112 (second modification):

Substituted subsection 112 (9D):

Omit “subsection (10AA)” (twice occurring), substitute “subsection (9B)”.
