Superannuation (CSS) Continuing Contributions for Benefits Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Act 1976.

1.   Amendment

1.1   The Superannuation (CSS) Continuing Contributions for Benefits Regulations are amended as set out in these Regulations.

[NOTE: These Regulations commence on gazettal: see Acts Interpretation Act 1901, s. 48.]

2. Regulation 3 (Classes of persons to which section 14A of the Act does not apply)

2.1   Subregulation 3(1):

Add at the end:

• “; (o)

  a class of persons each of whom:

  • (i)

    is a person (in this paragraph referred to as ‘a contributions-barred person’) in respect of whom, under the SIS Act, contributions to a regulated superannuation fund cannot be accepted; and

  • (ii)

    is not:

    • (A)

      a person who, immediately before the commencement of this paragraph, was an eligible employee and who has since remained an eligible employee; or

    • (B)

      a person (not being a person referred to in sub-subparagraph (A)) who, immediately before becoming a contributions-barred person, was an eligible employee and who has since remained an eligible employee.”.
