Superannuation (CSS) Approved Part-time Employees Regulations 2(Amendment)

I, The Governor-General of the Commonwealth of Australia, acting with the advice of the Federal Executive Council, make the following Regulations under the Superannuation Act 1976.

1.   Commencement

1.1   These Regulations are taken to have commenced on 23 June 1995.

2.   Amendment

2.1   The Superannuation (CSS) Approved Part-time Employees Regulations are amended as set out in these Regulations.

3.   Schedule (Modifications—person who is, or at any time after his or her first day of service has been, an approved part-time employee)

3.1   Modifications of section 3 (third modification):

Omit from subparagraph (a) (i) of the substituted definition of “period of contributory service” the words “sub-subparagraph (A), (B) or (C)”, substitute “sub-subparagraph (A), (B), (C), (D) or (E)”.

 

3.2   Modifications of section 3 (third modification):

Add at the end of subparagraph (a) (i) of the substituted definition of “period of contributory service”:

“or (D)in respect of which the person was not required or permitted to pay contributions because of subsection 3 (3); or

(E)in respect of which benefits did not accrue to the person because of section 55A;”

3.3   Modifications of section 3 (third modification):

Omit “sub-subparagraph (i) (A)” from subparagraph (a) (ii) of the substituted definition of “period of contributory service”, substitute “sub-subparagraph (i) (A), (B), (C), (D) or (E)”.

 

3.4   Modifications of section 3 (third modification):

After subparagraph (a) (iii) of the inserted definition of “period of employment”, insert:

“or (iv)in respect of which the person was not required or permitted to pay contributions because of subsection 3 (3); or

(v)in respect of which benefits did not accrue to the person because of section 55A;”

3.5   Modifications of section 3 (third modification):

Add at the end of subparagraph (b) (i) of the inserted definition of “period of employment”:

“or (D)in respect of which the person was not required or permitted to pay contributions because of subsection 3 (3); or

(E)in respect of which benefits did not accrue to the person because of section 55A;”

3.6   Modifications of section 3 (third modification):

Omit “; and” from sub-subparagraph (c) (i) (C) of the inserted definition of “period of employment”, substitute “; or”.

 

3.7   Modifications of section 3 (third modification):

Add at the end of subparagraph (c) (i) of the inserted definition of “period of employment”:

“(D)in respect of which the person was not required or permitted to pay contributions because of subsection 3 (3); or

(E)in respect of which benefits did not accrue to the person because of section 55A; and”

3.8   Modifications of section 76 (first modification):

Omit “sub-section (3)”, substitute “subsection (4)”.

3.9   Modifications of section 76 (second modification):

Omit from added subsection (3), “(3)   Where—”, substitute “(4)   Where:”.
